Where I live, believe it or not, I can terminate an associate even while on some sort of medical restrictions. I can even terminate that employee if he/she is out on workman's comp. They told me that all I had to do was word it in some manner that showed the associate was not available for the hours needed. I thought that sounded kind of cold and heartless, but that's the way it is here. Not all states are like that though. In Indiana, for instance, it's my understanding that you have to have documented evidence of poor job performance or something similar to terminate. Anyway, check with your local employment/labor relations office and they'll be able to tell you for sure before you go shelling out money on a lawyer. I'm really sorry for the loss of your job though. I know, when something like that happens unexpectedly, it has a way of pulling the rug out from under you. Whatever the outcome, keep your chin up. It'll get better. If you find yourself in a jam, who knows, maybe some kind of fund raiser can help. Let me know how everything turns out.
