It still would be pretty difficult to be protected in the restaurant business since the employer in a restaurant needs to make "reasonable accomodations" unless such causes "unreasonable hardship." And when your cook has to leave even for 15 minutes to suck down O2 when he's supposed to be cooking for 100 people during the dinner rush, that would cause undue hardhip since the only option the restaurant would have would be to hire another cook to hang around in case he needs to fill in.
