I hate to bring up a legal question, but...I'm currently in the process of following through with discrimination/retaliation charges with the EEOC under the ADA (Americans with Disabilities Act)against my former employer for wrongful termination. I was wondering if anyone else has successfully sued over cluster headaches? The federal investigators working the case have told me that the evidence is there, the hard part will be proving that I qualify under the ADA. To qualify under the ADA, the disability must limit/impact a major life activity. I have tried to point out that when I have a CH, I definitely qualify, but the Supreme Court has over the past couple of years, limited the application of the ADA severely. Anyone with information or comments, I would appreciate them... Thanks.
