Back to your issue. Jack, My advice is to pin a note (perhaps the judgement itself) on Lance, similar to Paddington Bear, with his mother's approval of course, so that as he unwinds the trail he left behind (or is it the trail he is going to leave ahead? Although, that's another problem altogether.) The note should say something to the effect that he has agreed to this reversal process and that for the next 9 months or so he should be watched so that he doesn't revert. Or is it prevert? Reverse his reverse direction, or something like that.
My guess is the IRS will not allow the current year deduction as he will not be born as of the end of the current year. As for the judgement, I'd prepare to file a 9 month continuance and see what happens then.
These timeframes presume, of course, that the reversal process will operate on the same linear scale as does the the forward process. The injection, injestion, inhallation, absorbtion or knowledge of Peruvian gas at any point, before during or after, should be considered in the timing decision. Does the Peruvian gas factor affect the time dimension or is this a forward-only transaction? Also, don't forget the butterfly factor.
