And now... Another installment of the Grapes of Rant by Drk^Angel...

Ya know... For someone like me, who is doomed to drag along for an uncaring, un-understanding employer, FMLA is salvation.  FMLA has saved my job so many times in the last 2 years, I can't even begin to count them.  Needless to say, I cannot stress how important I think FMLA is for those doomed to deal with both a chronic condition, and to werk for someone.

Now here's the rant... My employer should be fairly aware that CH is fairly permanent, and that my doctor will acknowledge that fact, yet they still insist I have the medical certification filled out every year.  I wouldn't mind this little speedbump on the road to FMLA salvation, if my employer wouldn't be so damn late in giving me the forms in the first place, then be so damn anal about getting the form back when they say.  They're supposed to give you at least 15 days to return the forms, so how much time do they give me?  9 days...  WTF?

Okay... 9 days... No biggie right?  Except the fact that my doc is at least an hour a way, which means either trying to be lucky enough to get a day off werk, and drive an hour to the neuro, just to fill out the forms (Of course, this is assuming I don't have to wait 6 months for an appointment), or I can mail the forms to the doctor.  So ideally, it would take approximately 3 days to get to the doc, one day for processing, and 3 more days to get them back... Right?  Wrong... I mailed them the day after I got them, March 9.  Well, the deadline comes and goes, and still no forms.  My employer gives me my final do or die date of March 25.  I finally get through to my doctor's office on March 23, but the assistance that handles the form isn't there, so I leave a message for them to fax the forms straight to my employer (the fax number my employer wouldn't give me until they notified me of the new deadline date).  I call on March 24, and the message had disappeared, so again I requested they fax the form, and they claim they'll fax it right then.  The beast causes me to miss werk on the 25th.  I return to werk on the 26th, and halfway through the day, I'm notified by my project manager that I've been placed on a final warning, and I'm damned lucky they didn't decide to fire me.  The next half an hour is full of lectures, of which, the only important thing they tell me is that my approval for FMLA has been cancelled, because the medical certification was never received.  FUCK!

So now I sit, one call-off away from being terminated, the beast still usin' my cranium as cannonball, the form that was supposedly mailed to me on March 22 still nowhere to be seen, the fax mysteriously gone, not able to reapply for FMLA until Monday, and wondering WTF?  The government giveth, and your employer's and doctor's minions taketh away... Oh well... C'est la vie... SHIT!

Drk^Angle,

I presume from your post that there is either a ‘set date’ each year this takes place or you notify the employer ‘to start the 15 day clock ticking’….y/n?

If so, why not have your own FMLA forms on hand? I doubt these are employer specific but if they are, please correct me. If they are employer-specific, spend a couple bucs when ya get a new set and make several copies for the following years.

When the clock starts, send your form off to the Neuro [fyi: overnite Airborne is about 16 bucs, not suggesting you have or want to spend that much of course].

Only problem left now, is getting your ummm….wonderfully cooperative employer to complete and return the forms. Here again, not sure of the details, but they say…squeaky wheel gets the grease. Push em, hound em, every day they hold you up. If you don’t get anywhere with the person or Dept actually handling the paperwork, go higher. Keep in mind, no company can ‘let you go’ for medical reasons, and ‘being heard’ to get needed documents, especially as allowed by law, protects you under those guidelines.

Drk life is full of shit sometimes and some people just seem intent on filling it that little bit more.....sorry this has happened to you!

On a lighter note, how's the baby doing... :)

An update... The forms mailed on Monday still have not arrived.  Looks like I'll be spendin' my Monday lunch break cussin' at some glorified receptionist on the phone.  I was hoping to turn in a copy of the forms when I reapply on Monday... Oh well... One way or another, it'll get done this time.

My brother had muscular dystrophy.  Had to miss a day of work every year to have a doctor certify that he was still unable to walk and should continue to get a handicapped license plate for his van. Ass-head bureaucrats!!
