Post by BarbaraD on Jan 7th, 2008, 6:31am Court Will Hear Lethal Injection Case By MARK SHERMAN Associated Press Writer Death-row inmates are asking the Supreme Court to order states to use different drugs or tighten their procedures to reduce the risk that prisoners will suffer excruciating pain during their executions. The justices are hearing arguments Monday morning in a case that challenges Kentucky's method of executing prisoners using a three-drug cocktail. Three dozen states use similar procedures. The court's decision to step into the case has brought about a halt in executions that is likely to last at least until the summer. Kentucky, backed by the Bush administration, says it works hard to execute inmates humanely, countering claims that its procedure violates the 8th Amendment ban on cruel and unusual punishment. Recent executions in Florida and Ohio, however, took much longer than usual, with strong indications that the prisoners suffered severe pain in the process. Workers had trouble inserting the IV lines that are used to deliver the drugs. The Kentucky inmates say there are problems with the three drugs that are administered in succession to knock out, paralyze and kill prisoners. The argument against the three-drug protocol is that if the initial anesthetic does not take hold, a third drug that stops the heart can cause excruciating pain. But that pain would be masked by the second drug that paralyzes the prisoner and renders him unable to express his discomfort. The inmates say that prison workers need better training and prisoners need to be more closely monitored for pain, or states should switch to a single drug, a barbiturate that causes minimal pain. The case is Baze v. Rees, 07-5439. Guess we can put them back in front of a firing squad. Patrick Kennedy was sentenced to death for the rape of his 8-year-old stepdaughter in Louisiana. The rape of a child is 1 of the few remaining crimes that doesn't involve the death of the victim that can carry the death penalty. The Supreme Court banned executions for rape in 1977. The last time anyone was executed for a crime in which the victim survived was 1964. Kennedy's lawyers say the death penalty violates his constitutional protection against cruel and unusual punishment. Louisiana's Supreme Court has upheld his sentence, saying it "can think of no other non-homicide crime more deserving" of the death penalty. Supreme Court justices will hear arguments in April. There are some who dont deserve compassion. |

The state did not want to be deprived of its habeus so they resurrected the corpus and as soon as he was stable.....they executed him. In old testament days...the family of the murdered person was allowed to kill the murderer. This insured quick and satisfying revenge. And would be a great plan as long as there is no way the person could be innocent. One truly innocent person on death row, exonorated by DNA evidence, tips the scales too far for me. Is the current way that people get executed cruel? I don't know, I don't think it is a huge issue. If there is some dispute, that is the court's job to look at. If the court says that one massive overdose of barbiturates is not cruel but the 3 drug mix might be, I am not going to going to get upset. Some of you may enjoy fantasies about inflicting pain on the convicted and condemned - that's your prerogative. Keep dreaming. I suspect there is a reason that the Constitution bans this. |

I was pretty clear that one innocent person on death row is enough for me to not support the death penalty, but if someone killed one of my babies...and I knew who did it....I honestly believe I'd flip out. I'm human. I'm a mom. and I'm not perfect. Gave up my sanctamonious liberalism back when the course of my life was changed by a psycho who beat me, threatened to kill my children, and got off scot free. So sling all the crap you want about it, its my opinion. Those who know me know I am not a violent vindictive or hateful person. kathy modified to add: Congratulations Monty. There were a number of people on this thread that expressed vindictiveness - some mockingly. From reading other threads, there also seem to be a fair number of people here that are in favor of torturing suspects - I wouldn't lose sleep if they all really are terrorists, but if someone was picked up by mistake and don't know anything?? Then we have abandoned our principles and lowered ourselves to the level of terrorists. And we lose any claim to object when captured Americans are tortured. You said that one person wrongly executed was too many, and that tipped the scales for you and made you against the death penalty. I respect that - while I am not opposed to executions as a principle, it is the ultimate, irreversible penalty and mistakes are made. So I am not a big fan of it. Our justice system needs to protect society from people who have no sense of right and wrong - and it sometimes fails. There are outrages that occur every day. But the fact that the Supreme Court is reviewing one aspect of the death penalty to see if it is in agreement with our Constitution does not strike me as an outrage. |

Post by Charlotte on Jan 9th, 2008, 10:05am for me, I do not believe in abortion which I see as killing an innocent person, but before I had my first pregnancy - I did beleive in it because i did not understand the preservation of life at any cost back then. for me, I do believe in capitol punishment - guilty person. I have had 2 family members murdered - in 1975 and 1981. In the 1st instance, the murderer went free because there were no "witnesses", in the 2nd, the murderer was another family member (19 years old, who killed his mother) and turned himself in and went to a prison for the criminally insane until age 25 and was released. I would have liked to have seen capitol punishment in both cases. However, it did not happen. Charlotte |
