Title: Scared feeling in the pit of my stomach Post by 1stdonna on Sep 9th, 2007, 12:42pm because my arraignment is scheduled for tomorrow afternoon. This is in result of the accident that I was accused of causing in August, and I am pleading not guilty. My only defense is that the officer denied me my right to talk to my witness at the scene of the accident. I hope the judge allows me to give my accounting of how it happened when I have my day in court, probably in about a month. Any suggestions on court etiquette? I've never been in this spot before and I'm scared to death. Prayers and vibes needed, please. |

His answer would determine whether or not the witness could actually see the accident. From where it really happened, there's no way he could have seen it. Thanks for the replys Rosy and Don. |

On a side note my nephew moved to north carolina in June.since then a 45 year old guy he works with backed into his truck and left the scene.luckily someone saw it and turned him in.he didn't have the balls to tell Eric.Oh yeah and no insurance.Last week he's driving down the road and a 72 year old woman crosses right in front of him.after hitting her car he goes into the guard rail.This lady has no drivers licence or insurance.we don't know whats gonna happen now.he has a little low rider s-10 truck.he lowered it did all the work on it including airbags and loved to take it to amature car shows.I don't think its savable.first the rear-end then the front end.the kid can't get a break.No insurance and or licence how do these people dare drive.do they think they'll never get caught? my understanding is my nephews insurance won't cover it but dang it it shouldn't have to.... Minnie who's just frustrated that people like Donna and my nephew Eric can get screwed . |

I'm going to assume you are going to dispute the Police Officer for the ticket you received. If so, in my state, it goes like this: you lose, you pay the fine. If he doesn't show up, who knows. Whats the worst that can happen? Pay a fine? Stinks, maybe unfair, but nothing compared to what Insurance companies can do to you. I got hit by a careless person who not only admitted 100% guilt, received the ticket and was found guilty in arbitration. But I lost $4,000 equity in my truck (so to speak), got injured and am still fighting his insurance co. I also got back a truck that was perfect originally, but came back with a bent frame that was supposedly straightened...but I measured it and it wasn't. Fact !!! Ill. law allows these things to happen. I had to trade it off and get another new one. I lost a total of maybe $6,000 , and I wasn't even at all to blame. Now my rates will go up. Read you states Insurance Commissioners Dept. website. It can help you to understand how your states laws will affect you. Good luck !! |

So far, she is ignoring me. She lives in New Jersey and I just wrote her again over a week ago, asking for a simple statement on paper, notorized as per the clerk of courts in my county. Yes, I am contesting the ticket and the arguement will simply be my word against the officers.......but I'm hoping I have a chance because he wouldn't allow me to speak to my witness, nor would he go after her for a statement. I already know that my fine will ba @ $500.00 plus court costs, my deductable to fix my car is $500.00 and my insurance rates will increase by $78.00 per month. |
