Title: Legal Question, NON-CH Post by ClusterChuck on May 29th, 2007, 3:33pm Tony (Artonio) and I were talking on skype, and got into a discussion. When you own a plot of land, do you own the air space above your land? If you do, how high do you own? In other words, here is an example: A person owns a narrow lot, of say 50 feet wide. You own the land on each side of it. Can YOU build a bridge, with the supporting structures on YOUR land, across his land? If you can't, why not? If you DO own the air above your land, can you stop airplanes, or even satellights, from flying over your land? If you can't stop them, why can't you, but you can stop that bridge from being built? Title: Re: Legal Question, NON-CH Post by catlind on May 29th, 2007, 4:05pm Can't speak for the US, but in Ontario you owned the land and 500 feet of the air space above it (or roughly that - it's been awhile since I had any real estate in Canada so the numbers may be off) All I know in regards to the US is that the military can take over the air space any place in the country at any time - in fact a flight home over mothers day weekend was delayed landing at Omaha because the air force base had declared use of the air space for training - was only a 15 min. delay, but it shows that there is no need for a crisis or imminent danger for the military to take command of air space. If I'm the owner of that 50' wide lot, and Chuck and Tony built a bridge over my property, I would be totally P***ed. For one thing, you're blocking out my sunlight - there goes my gorgeous summer tan! Not good. ;) For two thing, you're interfering with the natural breezes that waft over and through my property, which means no breeze, no open windows, more air conditioner, more money. Not good. ;) And, for three thing, Chuck and Tony would probably stop in the middle of the bridge to pee on my lovely landscaping. Also, not good. ;;D Items one, two and three, will win my lawsuit. I can BUILD the bridge over MY property and charge you people a TOLL to walk over it and pee off it (extra charge). But YOU can't build nuthin' over MY property without my permission (in writin') and that's gonna cost you a pretty penny. (I'm a mercenary wench!) Now that's assumming that I have obtained all the pertinent permits required by city, state and feds and build it to the specs requied by all ordiances and within boundries required by the easements in my deed of record and a lot of other legal mumbo jumbo. But now about your damn tree limb on my property. I'm fixin' to send you the rental agreement for that one. ;;D Seriously -- my neighbor's tree limb actually fell on my car in Shreveport and tore down my fence. He thought he was responsible and so did I. His insurance co thought differently. My car wasn't hurt and we finally decided he would just fix my fence (I had the stuff to do it) and we laughed about it. But I'm a good neighbor and so was he. The second one that fell, (on my truck this time) he got some help and got it off (no damage this time either) - we laughed about it and after that he CUT the damn limbs. But LA has some strange laws.... |
