Because this guy dies while driving drunk, speeding and talking on his cell phone with weed in the car his parents feel the need to sue everybody AND their brother.  

I think it's ridiculous. and I say it's time for people to be held accountable for their own actions.

I agree with you. When you give the lawyers free control, they will try to sue everyone that they think they might be able to get money out of. I am surprised they haven't sued the cell phone company as well.

I think it's a bunch of shit.....sorry but that's exactly what it is.

Yep....lawyers can sure add fuel to the fire....bad thing is a bunch of insurance companies will pay even when they should fight....it's cheaper than going to court.  Who eventually picks up the tab....we do!!!!

Personal responsibility is a dying art... >:(

This sort of STUPID law suit pisses me the fuck off!!!

The idiot was DRUNK!!  
HE drove the car!!!  
HE crashed and killed himslef (fortunately ONLY himself)!!!

And suing the tow truck operator, owner, and broken down vehicle?  WTF??

This lawsuit needs to be thrown out, and then criminal charges filed against the family and law firm for filing it in the first place!

It would open the door for a lawsuit against everyplace that serves alcohol in the country.   I can't see it happening.

 Let's see the state hired a contracter to put the median wall so sue the state,the contractor and the company that supplied the cement.The makers of the car that hit the median...it should have held up and not stalled thus blocking the road and causing the accident.

 The makers of the car he rented..for selling a car that doesn't drive itself if the operater is drunk.also no obvious do not drink and drive warnings all over the rental car...careless...recklless..sue em.

  Oh wait the parents of the deceased the should have had their son drinking when he was much younger so he could handle his booze....they also didn't teach him how to drive using a handless cell phone set..I'm sure theirs many  more that can be sued... [smiley=huh.gif] >:(   [smiley=hurl.gif]

  yes this family is hurt but blaming everyone else for their sons stupidity...and yes drinking and driving  especially that much is stupid.How many people may have been killed if he'd hit another car... :'(

Until the justice system starts throwing these ridiculous and frivilous lawsuits out on their ears, it won't stop.  I was a rehab specialist for workman's comp for 5 years and before the insurance companies did some solid investigations, plantiffs were getting away with more sh*t can you can imagine (and even then, the judges tended to rule on the side of the plaintiff).  

I know of one case (I wasn't involved in this one) where the plantiff had a back injury and required surgery.  Well, supposedly he kept having *pain* (is that subjective or what) and he was pushing for a large settlement.  *I* saw him driving a tractor, operating heavy equipment and every year during hunting season, he was traipsing about the woods, shooting deer and hauling them back in.  I do know that the insurance company hired investigators, but I'm not sure if they settled or not.

In another case (not mine), the plaintiff supposedly developed erectile dysfunction, so they insuror paid for a penile implant (his injury was not such that *that* part of his body would have been affected).

want more horror stories?  I have a whole suitcase full  :o

I don't understand why WE choose to continue to feed the problem. Once the verdict is handed down, why is it that every time, the JURORS (we the people) who are making the punishement decision always award the plantiff HUGE sums of money. When you know there is a GOOD chance that you will be awarded MILLIONS of dollars for some silly lawsuit you will sue.

An example is where I work (insurance company), a husband & wife sued for a boathouse that was damaged by Katrina. They where suing for an additional $40,000 that wasn't paid by the insurance company. They won the lawsuit and got there $40,000. BUT... the JURY awarded the plantiffs an additional $2.8 MILLION for pain and suffering.  >:(

It happened ever day, where you read about JURORS giving people truck loads of cash.

Another thing that kills me is if you sue me, I MUST spend my life savings defending myself. Why is it that if you sue & loose, you don't have to pay ME back the money I spent defending myself. I bet MOST of these bullshit lawsuits would not come about if you knew you lost the lawsuit, you'd have to pay all the court cost and lawyer fees to the defendant.

In England if you lose a BS case you pay everybodys bills.....thats what we need!

I just hired a lawyer to sue the payroll company that took $46K from me and never gave it to the IRS or state.....WHY the fuck should I have to pay for this fucking lawyer?

Guess what?....some mother- fucker is going to jail and I will visit just to laugh at them!

How in the hell do you become intoxicated involuntarily unless someone spikes your drinks?  Can a person not say, "No thanks" or "Make it just plain coca cola this time"?  If I have to drive, I don't drink.  If the wife and I both go out, one might drink (or not) and one will stick to soft drinks and plain juice or water.

They are going to sue someone for having a wreck and sue the tow truck driver for assisting the person who wrecked their vehicle.

How rude can you get to have an accident where some drunk speeding and talking on a cellphone might come along? And how annoying it must be to someone trying to drive drunk to have to navigate the road with tow trucks parking with their warning lights flashing and talk on their cellphone at the same time.

I'll add my voice to the cries of "What about personal responsibility?" here.

I agree with Bob that the additional awards handed down by juries have gotten way out of hand and that a "loser pays" court system might deter most of the frivolous law suits.

in defense of the club, his blood alcohol reading proves nothing except that he as deamed unable to drive as he was over an agreed limit. it doesnt prove he was intoxicated as such.

Or better still... if an attorney lost a lawsuit case they were executed. ;;D

I remember back in the day when there were no ambulance chaser commercials on the tube. Or when there were no disclaimer labels on anything...

Too late, numerous lawsuits have already been successful against establishments for serving too much alcohol to a customer.  The problem is frivolous lawsuits are won far too often.  A jury in Pittsburgh recently awarded a cash settlement to a fleeing criminal who lost his leg attempting to run a police road block - because the police should have known the the roadblock was dangerous.  Personal Accountability - why bother when juries award complete a$$holes huge cash settlements for blaming everyone else for their stupidity.        

To maintain an “open” legal system fees can't be assessed for loosing a case.  Perfectly legitimate complaints would not go forward if there were potential to have to pay.  Our current legal system is hopelessly mired in complex procedure, and “judicial discretion” it's not uncommon for the person who's actually right to lose because of procedural error or a biased opinion from a judge.  Truth and facts have little to do with justice these days.  Judges, lawyers and legislators have done a great job making the system so complex and conveniently flexible that average Joe’s and Jane’s don’t stand a chance if they don't hire a lawyer and even then a judge may use “legal discretion” to bend, make or skirt law.
 
A precise definition of “frivolous lawsuit” and a screening process would go a long way to keeping nonsense cases out of court.  Not just for individuals - insurance companies, corporations, political agencies, etc., etc., frequently misuse the legal system to drag out cases specifically to exhaust the resources of individuals and win by default.  It’s extremely difficult for individuals to match resources large organizations throw at cases they don’t want to become “precedent” for future cases – even when they have no legitimate legal standing.      

This would free up court dockets, expedite the hearing of meaningful cases and provide more time for argument and consideration of all pertinent fact.  Unfortunately every judge and trial lawyer would be pounding on our legislator’s doors and stuffing their pockets to stop it.  Too much money is at stake and too many lawyers would be looking for alternate employment.

Reminds me of the song by Tom Paxton-"One Million Lawyers"...would link to it but I have no friggin' idea how to do that....
and I think I should sue Dell, HP, SBC and Microsoft for making technology available to me, but not training me to use it....
I'd also like to sue the makers of my curling iron-the warning label that told me not to stick the curling iron in my eye fell off, thus leaving me vulnerable to injury.

Stories like that make me always say a silent prayer that Finland is not like that - at least, not yet. Back in here people don't feel the need to sue everybody over nothing.

But, because quite many in here like America and the way some things care done in there, it could be the one of these days something like that happends in here, too.

I hope not, though...

I really can't comment on this one because I recently filed a lawsuit against my parents because I suffer from Cluster Headaches. My attorney thinks it's a slam dunk.

Is it true that the US has more law students in school than the rest of the world has lawyers?
