We have a friend who is a single dad, put in the same situation. He however, had papers drawn up before he left that stated she could not and would not fight for custody when he returns. He did however give a limited amount of time after he returns for his son to be returned (2 weeks I believe). She agreed and the papers were legalized. Does this mean that he is safe, no. But it does help if there is a battle. She has a legal obligation, to return him. The bad thing is, the military doesn't inform single parents of this prior to leaving. So a lot of times the other parent/guardian is only taken at their word. And that doesn't hold up in court. |
