The jury came in with a Not Guilty because of MENTAL Defect in the Andrea Yates case (the woman who drowned her 5 kids in the bathtub down here in East Texas). At the first trial they said she was suffering from Post Partum Depression.... (hell, anyone who's had a baby has suffered from PPD and most of us didn't kill our kids).

Now they're going to put her in a mental facility (under court supervision -yeah right) until she's "cured" and there's a chance the woman could be back on the street in the future, having more kids and killing them. At least Susan Smith got Life without Parole - although she's seen the error of HER ways and has gotten religion now (bless her little heart).

I just get angry with cases like this... anyone who harms a child (regardless of reason) needs to be hung at high noon.

I'm going to go hug my little Caleb right now and tell him Granny loves him.

I heard that too, Barb, and the hair on the back of my neck stood up.  It's just wrong on so many levels.

Not to worry.  She WILL be judged.  But that comes later, by a Power much higher than us.

Hopefully they'll at least rip out her uterus (preferably without the use of anesthetic) so she can't have any more kids to drown.

I was friggin shocked when I read the verdict.
Those little kids never had a chance with that crazy eyed trailor trash. WTF, the husband didn't see anything strange about her while getting her pregnant every friggin year? >:(

If you ask me the husband should have been on trial as well. He did know something was wrong, but he belived she could work through it.

My understanding was that she tried many times to tell people that something was wrong and everybody ignored her cries for help.

I am not saying that she is not responsible, but I think the father of the kids should have been on trial as well.

It's disgusting to me that a jury would allow this . . . did they check their common sense at the door?  I'm especially attuned to this since I start jury duty next week.

First off you would have to be nuts to kill your own kids, so how the hell does that excuse it?
There was a gal her that through her two kids in the SF bay and they drowned, don’t think they have gone to trial yet but this one has set the president so she will also get to go to the Ha! Ha! Hotel instead of the big house where she belongs.

Just wanted to say that she had post partum psychosis, which is very different from PPD.  Basically, you're not you, your brain is FUBAR'd and unreality IS your reality.

And just because I brought up this point, don't call me a sympathizer either, as it's not my place to judge (thank GOD).

Juries are supposed to be made up of your "peers".  How many of us have been called for jury duty and have found a way to bail out of it?  How many potential jurors are "too ill", "too busy at work", too whatever to serve on a jury.  So Yate's jury probably consisted of those folks who either don't work and have all the time on their hands that they want, are healthy as pigs, poor as dirt, or were too stupid to come up with a plausible excuse not to serve.  They were her peers.

Don't get me wrong here!  I've served on three juries in my life, one a murder trial.  If I'm called, I serve.  The only excuse is if you are really too ill (hospitalized, under docs care, ete - then with written excuse), too mentally challenged, or dead.

Serving on a jury when called is not a priviledge, it's not a right, it your duty as an American citizen.

HI, i AGREE!  And, my question is:  when the doctors agree that she is sane enough to be set free, will they try to prosecute knowing she can't play the "insane" trump card?  It's all over the t.v. here in Texas.  It's only going to get worse.  I hope not. kev.

This reminds me of a case, many years ago, that I was involved with, back when I did clown work.  I used to visit the children in the burns hospital in Boston.  One child, that for some reason took a real liking to me, was so severely disfigured from burns to his upper body and face, that you could hardly tell it was a human child.  I used to make special visits to be with him, even though I would have to leave the room, periodically, as I didn't want him to see his "special friend, Chuckles the clown" cry.

How did he end up there?  His parents were going thru a divorce, and a nasty child custody case.  One week end his father took him, brought him to a motel room, poured gasoline on him, and then set him afire!  His thought was, "If I can't have him, nobody can!"   He also planned on killing himself afterwards, but then chickened out.

What was his punishment?  I forgot, exactly what it was, but it was something like six months probation, and a thousand dollar fine!

WTF is with the court system?

I guess this one really got to me. Most of yesterday, I just held Caleb and kept telling him Granny loved him more than anything.

And the husband has already remarried and is probably having more kids. He said he didn't want her convicted because she was sick. Why the hell didn't he get her some help? Yeah, Jonny I think he should have been on trial also.

I think the death penalty should have been given in this case. Let her go to "that better place" where she sent her kids.

If MY wife, mother, uncle or ANYONE killed MY 5 kids, weather sane or not, I would want them convicted and either in jail for the rest of their lives or dead.

What about those kids ? Ooops sorry, she didn't know what she was doing so it's o.k. 5 kids will no longer get the chance of enjoying life. It just doesn't make since to me.  :'(

To be found "not guilty" under the McNaughten rule is very, very rare.  Andrea Yates is a very sick woman and will probably spend the rest of her life in a state mental institution.  Despite the horrible nature of her actions, Yates really believed the voices that were telling her to kill her kids.  She was/is a severely psychotic person and the sentence that she received is what one would expect in a civilized society.

I've been following the trial on Court TV and all I have to say is this:

"Not guilty by reason of insanity" means that at the time of the crime the person did not know RIGHT from WRONG!

This bitch called the cops right after killing her kids. Why did she do that if she was insane enough to not realize she did something wrong? Ya know, call me crazy, but I never call the cops to come out for no good reason. She called the cops because she MURDERED her kids and KNEW she did wrong. Think about it.

That was uncalled for Tom. Jean was a law enforcement officer and put her life on the line more than once to keep the streets safe.

What I see happening in this case is that while in the mental hospital, Yates will be given meds that will miraclously cure her and she'll be put back on the street declared "cured" of her mental defect. And she gets away with killing five innocent kids. Not right in my opinion.
