I was just wondering if anyone knew where online I can find out if a certain business name has been trademarked?  I want to name my business something, but don't want to get in trouble due to another business having the same name.

Can ya help me?

I don't know if it depends on the state, but in OK we go to the Secretary of State to register the name, et al.  and if the name is already taken we cannot use it...you might check with your Sec of State???

Here in Michigan, we have to register our DBA (Doing Business As) with the County Clerk's office.  They automatically search the state database to be sure nobody else uses that DBA in the state.  Unless you're incorporating, your business name is normally not a problem since your tax ID is the same as your social security #.

There are a couple of major corporations with the same name as my little one woman show, but because I'm a sole proprietor it's not a problem.  Good luck!

Thank you so much Kris!  I won't be incorporating, so I guess I can use pretty much what I want.  I did check the nationwide white and yellow pages though, and there is NO business with the name I want, so that's cool too!

My little home business will now be known as...

"Balloon Enchantment"

 Hope ya don't mind me having fun with this.been missing the girls and this keeps my mind off it.I almost even miss their fighting  :-/  . Oh well they're having fun with Daddyand thats all that counts...
 so ya didn't say ya like the commercial it really is innocent unless you have a dirty mind...like mine  LOL

The safest thing to do is set-up a sole-proprietorship . ( spell check). You'll have to fill out a minor form and pay a very small fee. Then the business is set-up. You only really have to perform a name check if you are going to incorporate in a particular state. The town that has your county courts is the town where you can enter the sole-prop. thing.

WOW, great news Mel. Didn't realize you were turning into an entrepenuer. GREAT

I'll offer a word or two of advice from experience with small business here. If you're planning on advertising in the phone book (it CAN get expensive) these are some of the tidbits we've learned.

Everything is listed alphabetically, therefore, starting your name with a "B" would be an advantage. Some people just phone the first ones they see, and B names are at the top.

Ours starts with a "D", so not bad either.

My son picked his name for his business by sitting with a dictionary, opening pages and pointing until he found something he liked.  LOL  It was good, we all like it and it's been 8 years running.  So, good luck gal, sounds like a real fun business.

Hi Mel, it has nothing to do with whether you are a corporation or not, its just a registered name.  In my state it costs $50 to register a name, and they just check to see if the name is being used when you send in your registration info.

So, your legal papers would read as: Melissa, DBA Balloon Enchantment.
