"I'm just shocked," Shelltrack said. "I really thought this would all be over, and we could go on with our lives."

The current ordinance prohibits more than three people from living together unless they are related by "blood, marriage or adoption." The defeated measure would have changed the definition of a family to include unmarried couples with two or more children.

Mayor Norman McCourt declined to be interviewed but said in a statement that those who do not meet the town's definition of family could soon face eviction.

Black Jack's special counsel, Sheldon Stock, declined to say whether the city will seek to remove Loving and Shelltrack from their home


I'm not saying they should change the definition of family...but really, why not? If you and your spouse has 2 or more children ... Doesn't that make you family?

I know if I lived there with my childrens' mother, even though we never got married, I would not let city council evict me. IT would have to be by force!

How absolutely fucking retarded!  So if let's say my husband and I get divorced, and I rent an appartment/house with my 2 kids, fall in love with someone else and have them move in...I could be evicted there?

I guess law would apply to both renters and home owners. You would not be able to get an "Occupancy Permit" if there were more than 3 people living together unless the 3 were related by blood, marriage, or adoption.

What if I wanted to move there and have a couple of room mates ? NO CAN DO !!

The children are related by blood to both parents, there are only 2 people who aren't related.  They fall below the 3 person rule.  

Mother and 2 children= related=3
Father and 2 children=related=3
Mother and father=not related=2

The math there is faulty and could be argued?

What the hell is an Occupancy Permit? Isn't Missouri part of the USA? Or is it a communist nation all to it's own?

Sounds like some of the nazi controlled Home Owners Associations here.

Where's the ACLU when you need them? Might be worth moving there just to sue their balls off.

I believe this law (and others like it) stem from a 'good place' which is to keep Julio and his 15 friends from occupying the house next to yours under the protection of 'hey, we're all just renting it'.  Especially if it's a semi-quiet family neighborhood.

So far as owning a home the government has business telling you what you can do inside of it, outside of it, or how many people you care to have living with you. So long as no one's rights are being infringed upon let's all remember: it's your castle.

Here, it's not Julio that is the problem, it's Bong Wing and the Patel's that crowd populate, and they generaly stay to themselves, so who cares. The only detriment is that they send a flock to the schools, and don't pay their fair share of school taxes, as they are included in property taxes here.

You mean only us midwesterners have to pay occupancy permits? It is always  nice  $50 addition to anywhere you are scraping up the money for both first and last months rent plus deposit. I have paid for occupancy permits here in Illinois since moving back here 10 years ago.

And as far as the Blackjack ordinance goes? That is totally fucked up! What the fuck ever happened to the LAND OF THE FREE?

I can see not wanting or allowing 10 people to occupy a 2 bedroom house. But in this particular case, we're talking about a mom and a dad and their 3 children. Since mom and dad aren't married, they have to move out of that CITY (not just the residence). There is a flaw there!

So, if I do win the lottery and plan on building a big 6 bedroom house in Black Jack, MO and moving in a few close friends ... I CAN'T BY LAW ?? There's a flaw there too.

So is BIG BROTHER gonna monitor our HOMES now? This is a ridiculous ordiance and should be challenged. Where's the ALCU when you need them?

A few years ago there was a story about divorced parents and custody of the kid. The mother was "ordered" NOT to smoke in her house if she wanted to have her son visit.

Let's face it - WE'VE given too much power to our "elected" officials and now they're trying to place their "druthers" on US. If we just sit around and take it - we deserve what we get.

These laws have been around for a long time in many areas - people do want to keep boarding houses out of suburban neighborhoods.  They do want to keep student ghettos from spreading.  Big brother doesn't check on each and every residence.  But if 5 or 6 college students rent a house in a nice neighborhood, and bring Animal House lifestyle to the burbs, they can be evicted.

The hysteria seems to be related to a government definition of what a family is - in a few cases, there might be an extended family that doesn't fit the restrictive definition from Black Jack.  One man, one woman, their kids.  That's  the definition the fundamentalists want - anything beyond that is illegal.
