Title: WTF is wrong with some people???
Post by Melissa on Mar 20th, 2006, 12:27pm
I am pissed, and need to vent.  So here goes. :P

Jesse (my hubby) has a friend who is 5 yrs younger than him, that he grew up with down the road.  Now I'll tell you, he has always been so good to him, helping him fix his cars, and even helped him build his house about 5 yrs ago.

Fast forward till yesterday.  You see, his friend sold his house to Jesse's brother and his fiance (they are the ones who have my godchildren Ethan and Hailey) and they bought a different house.  Well, turns out, that the walls are molding on the inside and it all has to be ripped apart and replaced.  Hubby said it was due to Luke (that's his name) not letting his lumber dry before using it (he cut and planed his own).

Now when my future sis in law called up Luke & his wife to confront them about the mold, Luke's wife told her that the reason why there was the mold, was because Jesse is the one who helped put the siding on???  Um, HELLO????

I knew someday something would happen where Jesse would finally say "fuck it" to being a friend to him.  Jesse's always picked up the check for dinner, helped him out when he was in need and has ALWAYS been good to them.  Now this is how he's being repaid?

It kills me that someone as good as my husband is being shit on like this. >:(

Now, here's where I am at right now.  I have blocked Luke's wifes email addy and deleted her from my address book.  For some odd and weird reason, I do not feel anger inside me.  I feel like karma will take care of it.  It always has for me and it always will.

BUT, I am scared that I actually thought of spamming her to death where she works and a few other things. :-/

So tell me, am I a bad person? ;)

*sigh*

When someone we love is hurt we feel the pain too.You are proud of Jesse's good heart and to see it abused hurts. Please don't let someone like Luke and his wife break your generous spirit. For every ungrateful jerk out there theres someone who really appreciates the help and will pay it forword.Mel you don't have a
mean bone in your body and you are not a bad person.Don't let the petty people in the world get you down.I hope the house not only gets fixed but is 100 times better than anything Luke and his wife gets and it's value keeps rising.
Minnie who has a slight vengeful bone and hopes to someday be a better person

Melly don't worry, you really don't want to know the shit I've thunked up as revenges!! LOL The good new's is I haven't done any much of it  ::)
Thinking about ways to do it ends up making me laugh so much that I lose my vengeful streak and like you I tihnk karma is it's own reward.. just think on. He has lost probably the best friend he will ever have and as for her? Well.. she's married to him! How much more karma do you need than that?!

Thanks Minnie.  [smiley=hug.gif]

I know it sounds stupid, but it alarmed me that I actually thought of doing something purposely to make someone else's life more negative. :-[  I am not like that, and I think I caught myself before stepping over that line.  *phew*

love ya hon and we will get our just desserts in due time!

Helen, so it's healthy to think of things to do, just don't act on them, right? [smiley=laugh.gif]

Ya know, it's funny, those of us who leave it to fate, tend to have a TON of ways to screw up someone else's life! ;;D

Ahem...not that that's a GOOD thing or anything. *whistling* ::)

Melly, I prefer Mother Nature to extract a pound of flesh when necessary. I TOO believe what goes around, comes around.....
BUT....
Being the devil's advocate here.....did anyone have an inspection performed on this house????
Nobody looks out for you better than YOU!
(that's just the Realtor coming out in me, but)

I'd be looking to take these people to court......not sure about your laws however....
every state has disclosure laws
every state is currently really into mold illnesses
every mold issue can be traced back to a beginning

SUE the lily-livered pondscum!

Spamming her to death at work won't help anybody. And it could come back to haunt you.

Be the bigger person. Ignore Luke and his wife.

Sounds like Jesse's brother needs the help now.

And about the mold..........

not letting his lumber dry before using it (he cut and planed his own).

Jesse is right about that. And green lumber will warp as it dries and crack the walls. Sorry, but there might be a lot of repairs to be made.

See, that's what's so weird!  It was inspected and other than possibly needing a new septic (which they have on the contract that if they do, the previous owners have to pay for it) nobody knew it was due to the walls until another of hubby's brothers got sick and had a bad asthma attack in it.  They had thought it was coming from the basement, so they were going to have it sealed, but further inspection by themselves (Jesse, his dad, and all of his brothers are constructors) showed that that wasn't the cause.  Unfortunately, this is what happened.

Now my brother in law and fiance have to deal with the house, a wedding in June and recently a sick baby (Ethan is just getting over a viral infection and was in the Hospital).

I tell ya, when shit blows, it hits the fan X 3!!

BTW, we have told them to get an attorney involved, but of course, it is their decision.  We have NO problems with a fight!

I know, that is what sucks.  Jesse will help them rebuild, which I am sure his brothers are going to do to also, but due to his severe allergies and asthma, I'm not sure how well a respirator will work for hours on end with that house. :-/

In most states, sellers are legally required to disclose defects related to real estate.  Time for somebody to get a lawyer.  Friendship is fine, but this deception is fraud with serious economic consequences.  Start taking pictures, start writing things down.

Quote:
Because of stricter disclosure laws and higher expectations from buyers, sellers have more responsibility to disclose any fact that could affect the sale of the property.

States are cracking down on sellers' obligations to disclose known material facts about a property for sale, especially conditions not readily apparent to a buyer (such as a cracked foundation). A material fact is anything that could influence a buyer's decision to purchase a home or affect the sales price. The major cause of post-sale disputes and lawsuits involve defects and disclosure. Most of the cases could have been avoided if proper disclosures had been made.

Learn the law

The statutes governing a seller's obligation to make disclosures vary by state.

* State laws: A majority of states require some form of seller disclosure. The disclosure form also varies. Some states require a seller to complete a form that includes questions about the property condition. In other states, disclosures can be made verbally. In some states, seller disclosures are voluntary. The only sellers excluded from disclosure laws are banks and mortgage companies with foreclosure properties.

* Federal and local laws: In addition to state statutes, some local and federal laws require sellers to make specific disclosures. Federal law, for example, requires sellers of homes built before 1978 to disclose any known lead hazards.

Mel, you're not a bad person!

Just angry and you have the right to be. I think that you have chosen the perfect revenge: let the karma take care of them. They'll get what's coming to them. In the meantime, enjoy life. :)

Best wishes,
Sanna

I think the operative word here is "known'. Did the sellers know that the walls were mouldy on the inside? If so, there may be a case. If not, I would look to the inspectors, they might be liable for not finding such a serious issue.

That's just the thing.  He didn't know about the mold, but he knowingly built the house with undried lumber. :-/

Here comes the nasty house inspector, usually costs $2-300 most places. The buyer pays the fee.
"Fast forward till yesterday.  You see, his friend sold his house to Jesse's brother and his fiance (they are the ones who have my godchildren Ethan and Hailey) and they bought a different house.  Well, turns out, that the walls are molding on the inside and it all has to be ripped apart and replaced.  Hubby said it was due to Luke (that's his name) not letting his lumber dry before using it (he cut and planed his own)."
A good inspector will see that sort of thing right off the bat, and as someone said earlier, not disclosing defects in a real estate deal is grounds to recover any expenses from the sellar to resolve the problem.

Mel,

First off, you are NOT a bad person. Your reaction is normal, and I would think you a bad person if you just shrugged it off.

I have had the unfortunate luck to deal with people like that, so I understand. These things hurt worse than we like to admit.

Sooner or later your husband will find a better friend.

Umm, well, ok, no problem.
got lots of big fish down here and lots of neat ways to make people disappear. ;;D
There's no good way to deal with low lifes but take heart, I've had similar things happen to me and the "friends" always get what they deserve eventually.
They may be innocent of the mold problem but the comment about the siding works is just wrong (Sounds to me like they knew they had a problem and are trying to shift the blame)
Priority one should be fixing the house.  I hate dealing with lawyers but it seems that thats the way things work now.

Mel, your NOT a bad person. Its ok to think those thoughts. I'm real protective of my family as well. As with the house... I think you have to have a specific mold test done on the house, not just an inspection. Its a whole other test. I know they do it here in MA, but its one of those "optional" tests if you want it done and it is extra $.

That doesn't relieve the seller of the cost to resolve the situation.

Mel,

Take a deep breath....

If you paid an inspector, he should have caught any defects. Go back on him. That's what he gets the big bucks for. In most states there's some teeth in the "inspection" laws. Get on the net to the Real Estate Commission in your state and see what the inspectors are "repsonsible" for and what your remedies are before you blow up and start passing the blame.

And yes, the sellers are responsible for telling the potentiel buyers of any defects, but the inspectors are responsible for finding defects and disclosing them. The sellers can always say they didn't know about them (innocence is bliss).

I've found out (after 30 years of being a Real Estate Broker) that there's usually a way out of these situations without everyone getting their panties in an wad.

Hugs BD
