Does anyone have any lawyer training to answer a question........suma ya know I have a small dog business at home....not a big kennel and I don't advertise it cept a few adds in the paper when pups are ready....and alot of 'word of mouth' sales. We have the dogs setup like a 24 day care here and all can go outside when they want with one big chain lenk fence pen for 'the girls'.....they even have a cabin Brad built them with metal room to run up ramps into and play in all sorts of weather. Anyhow.......I have gotten several calls from people lookin for pups (chihuahua and dachshunds).....and beleive it or not MORE THEN HALF of the people that have called me the past two weeks have or are still 'in the process' of sueing there breeder or vets !!!!!! WTF ?? The people were DUMB enuff to give me details.....and they went for BIG FREAKIN BUCKS !!!!! Is there ANY type of aggreement a person can have written up or write that would protect them from that when dealing with the public ????? I have no contracts cuz there are NO gaurantee's with anything and people can hold THEM against you. They can drop a pup or dog or kid kick it whatever and decide it was that way when they got it and SUE THE PANTS off you......there are alot of diseases showing up BIG TIME now with so many tryin to run puppy mills and selling mass quantity's of dogs that are carriers. Sum stuff only shows up with stress (ya wean, worm and sell one within a few days and that is alot of stress)......they can fall victum to things IN the envirement lurking 24/7. Early shots now has some risks they are linking to severe anemic attacks out of the blue so I am pushin my dates back with that. So again I have a book here most will ignore.......but if anyone has any info I'd appreciate it. I'm not sure I even trust lawyers to call and ask them without some knowlegde what to do to protect myself from shewd CREEPS !!!!! It is gettn scarey and the lawyers tell them now to go for 'pain and suffering' cuz of the sick pets care and your grief. This is getting out of hand Pam

I'm not an attorney but I have lots of rental properties. If I was you I'd see about getting some liabilty insurance coverage. Now days people will sue over anything. You probably should have some type of contract stating if the dog gets sick within the first 10 days you will return the money or give them another dog. Surf the web maybe you can find a sample contract. Anyone can take you to small claims court for about $50 it just depends on who presents the most proof. So just make sure you keep good records and get the pups examined before you sell. I believe as long as you are a honest person things will work out. I had a tenant try to say I put her stuff to the curb illegally and destroyed $10,000 of her belongs. This was 6mo. after the fact. She basically made a christmas wish list. Fortunatly I had pictures of her junk which I had to pay someone to discard and I also had a note she left saying she had got most of her stuff out and would be back the next day to get the rest. She had no receipts of anything she had purchased just a christmas wish list with an est. cost. She also tried to play pitty on the judge by saying there were priceless metals that her handicap son had won. She of course got nothing. The judge can tell who's being honest. If anyone does ever take you to court the best thing to do is stick to the facts, say as little as possible , don't offer anything unless you're ask. Hope this helps some.

Yeah really....THANKS for the info and WELCOME !!! Maybe it is a good idea I have my vet 'check' each pup.....at least that way if someone tried to say it got sick later and had sumthin (sumthin it could of got elsewhere or they tracked in) he mite be able to help me out with a statement at least. BUT if I had him give shots and check them it'd cost me SO MUCH total per litter I'd loose my ass. I have had people call me and state they want a gaurantee the pup will never develope any diseases including any siezures (forms of head trauma while they had it could cause that ) or any other dog ailments like epilepsy ect ect. You can't gaurantee that stuff.....no one can. Some want contracts good for the next year or for life of the pet !!! I have had alot of people make demands and threats durein the same phone conversation and I don't want to deal with them at all. I've heard anquish pain and suffereing thrown in several times this year cuz the lawyers "sudjested it' since they were upset there pet got sick and kids traumatized !!!??? Wish I could sue everyone that has ever sent me a bill FOR THAT Pam

Thanks again for the GOOD advice.....this shit is SPOOKIN the hell outa me..........pet stores charge double or triple for the same quality pets (without any parent info) to cover there asses replacein them. I can't get them prices.......people even been callin bitchin me out I won't GIVE them one cuz they are poor and want one. People suck..........................ya know ?

Pam let everyone sign a note that they received the animal in good condition and add to the bottom a disclaimer, that from date of ownership you will not be held responsible for the health of any pup.

Pam,

The kennel we use for our three Goldens, Barkingham Palace also sells Puppies. They purchase the dogs from a place called Tracys in the Mid West. This is not a puppy mill. Tracys buys puppies from Home Breeders and ships them all over the country. Teddy one our males is from Tracys and was born on a farm in Missouri.

Anyway, Barkingham Palace has a contract for all the puppies they sell. If you would like me to get one for you I will ask the owner and send it to you. Just let me know. I would need your address on a post or PM. Or I can give you there phone number and I will call ahead for you so he can send it you if he will.

BTW Barkingham Palace has private rooms for the dogs with Color TV and air conditioning. A lot of places in New York are doing this now for marketing. Quite frankly I don't think my dogs care if they have color TV. At least they haven't told me yet.
