This is not just about smoking "workers who refuse to take a health survey..............don't follow doctor recommendations" this part has nothing to do with smoking and will effect us all if we do not stop it now. Please pass this on to everyone you know and let's start a nationwide boycott of Scotts. When they lose more in sales than they save by firing people, and if they get enough bad press they will see the light. Call 937-644-0011 Ext. 7431 today and ask for James Hagedorn let him know what you think of this and how you will no longer buy Scotts products until they change this policy. The lawn and garden company wants workers to live healthy lifestyles, said James Hagedorn, the company's chairman and chief executive. Scotts recently opened a $5 million fitness and medical facility. Scotts is joining other companies focusing on smokers to cut health insurance costs. Some companies make employees who smoke pay higher health insurance premiums, or don't hire them. "Why would we admit someone into this environment when they're passing risk along to everyone else? Our view is we shouldn't and we won't," Hagedorn said. Scotts, which made $100 million on sales of $2.3 billion in its last fiscal year, has 6,000 employees in the United States and overseas. It said it can fire smokers legally in 21 states. "We're being as aggressive as the law will allow us, to keep our costs under control," Hagedorn said. Scotts pays for 75 percent of employees' health insurance but won't say how much that runs. The company also will require higher premiums for workers who refuse to take a health survey in 2006. In 2007, premiums will rise for workers who don't follow doctor recommendations to improve their health. In a 2004 survey of 270 professionals, the Society for Human Resource Management found 4.4 percent preferred to not hire smokers. Fewer than 1 percent said their companies have a formal policy against hiring smokers. This year, Okemos, Mich.-based Weyco Inc. began firing workers who smoke. Scotts, based in this town 30 miles northwest of Columbus, is offering free counseling, nicotine patches and classes on quitting to workers who smoke. The company hasn't figure out how it will determine whether employees are in compliance, spokesman Jim King said. |

Post by JenniferD on Dec 14th, 2005, 7:32am take it a step further...... workers who practice unsafe sex will be fired. workers who use- NOT ABUSE - alcohol will be fired. workers who have children (may need time off for illness) will be fired. workers who commute (may get in an accident) will be fired. workers who argue with their spouse (stress) will be fired. I'm not one of those "smokers rights" people, even though I do smoke, I respect those who don't like it and don' t want to be around it.....but what people do on their own time is not for a company to decide. |

The owner was going to impliment a new policy next. There spouses at home can not smoke either because second hand smoke is just as bad if not worse for you. He offers a fittness center for his employees and their families and offeres a ton of things to help the person stop smoking. This is legal in about 21 states. WI is not listed as being one of them so there may be a court case comming up Redd. But the other went all the way to the state supreme court and held up but that was before he started in on the spouses. |

Some of them abuse the 'going out for a smoke' thing... figuring that they make the smoking trip about once per hour, at about 10 minutes per round trip. It adds up. One could see how that is a logical business decision. Personally I would prefer to see them smoke at their work-area, so long as decent ventilation is present. |

Smoking is only allowed in bars that win not easy to obtain-waivers. No one smokes in retail establishments here and you have to be specified distances from buildings in certain areas to light up. Some states have even tougher laws. Isn't it Ireland that enacted some draconian smoking laws? http://www.netsync.net/users/charlies/gifs/hand on hip.gif It won't go away because those in charge here are by far non-smokers. Guys who have never smoked though have no idea how strong the addiction. I still dream about smoking after all this time. Ebay book sellers often make a point of stating that the books they offer come from smoke free enviornments. For guys like me of course.... well you know the story. They didn't look like they were kidding. We got them some Coke. Coke adds life. It's the Real Thing. |

No smoking in bars is just wrong. But, I do like no smoking or non-smoking areas in restaurants. I am a smoker but don’t like eat with the smokers. |

It's happening everywhere. Unfortunately I can only see it getting worse. This year our company is doing basically the same thing, except you're not getting fired, just not getting a bonus. This year it only includes the employees. Next year it includes the employees, along with anyone living in their household. :( |

Post by maffumatt on Dec 14th, 2005, 7:49pm you cant smoke on railroad property, even the tracks, you have to step off the right of way, in otherwords you have to get into the weeds or trees to smoke, those rocks are much more combustible tthan weeds and brush you know. |

Then you have the people who cry about the second-hand smoke & they're the same people that start up their car to go 100 feet down the road...to the store. Do they realize how much pollution and second hand smoke comes from a car...a fireplace, an oil or gas burner...or even their damn underarm deodorant. Where does the madness stop. Please... |

I think our constitution (like the Bible) has been interputed to the point of proving everyone's point to the point that it doesn't prove a damn thing any more. We've gotten to the point of trying to be so "politically correct" that we've lost all the basics that this country was founded upon. "In God We Trust" has lost all meaning. Today we can't even say, "Merry Christmas" without being censored. Now we're letting "them" tell us how to run "our" businesses and what to do in "our" homes. Maybe the SOUTH should have won -- then we'd all be drinking Mint Julips and ....... oh well..... it's a good thought ..... Hugs BD |

The four businesses in violation of the state's Clean Indoor Air Act were: Westside Tavern, 219 Hoffman St.; Ward's Grill, 416 Luce St.; Lepky's, 1150 S. Main St.; The Boar's Nest, 519 Erie St. Each establishment agreed to pay $500 to settle the violations. The maximum penalty for each violation is $1,000, the health department said. The state Clean Indoor Air Act prohibits smoking in indoor public locations. The law took effect July 24, 2003. The county health department said it has fined 10 businesses for smoking violations since the law was enacted. Thomas G. Kump, director of environmental health for the health department, said most businesses have followed the law. “Most restaurants and bars are doing a great job of enforcing the smoking law,” Kump said in a written statement. “It is unfair to those facilities that are complying with the law when other establishments are still allowing smoking.” Nine Chemung County businesses were found in compliance with the law during the health department's recent checks. Those businesses were: The Hot End and The Glass House, Elmira Heights; Keefe's Tavern, Chill and Angles, Elmira; County Tavern, Southport; Harris Hill Inn, Big Flats; Amici's, Horseheads; and Five Acres Tavern, Chemung. The employer can specify what (if any) jewelry is appropriate for work, what hairstyles are allowed, and what people wear and say to other workers and customers. Nothing to do with PC - it is about the corporation regaining control of your lives. Makes me long for the good old days, when Henry Ford sent detectives out to keep track of who went to what church on Sunday, and how often. Workers that were insufficiently religious were routinely fired, which helped enforce Ford's beliefs among the remaining workers. I'm not saying that Christmas is a pagan holiday with a Christian veneer, but I wish you a blessed Yule; may the all seeing Odin judge you favorably when he flies over your house! |

After reading this thread I asked the coke delivery guy at my job if this was in the least bit true. And the verdict? Positively YES... the stipulation however is more logical. At least from the delivery guy's perspective. You see they get paid by the case the more cases he delivers the more money he makes, so the company's standpoint is (outside of common sense) that if you are participating in ANY sort of Company business you are limited to Coke products That means on the clock or during any sort of meetings or company gatherings its Coke or nothing...Albeit I doubt water applies. The same is true of Pepsi employees... I shall confirm that with the Pepsi personnel when our company switches as of January 1st. Oddly enough...the rivalry is SO intense that if you serve Coke at your establishment and you cancel your contract with them you HAVE to verbally tell them to come get ALL related equipment because once the contract officially ends...they CANT come back and collect THEIR property...usually rented equipment (ie) CO2 bottles and vending machines and so on. And you get STUCK with them unless you renew your contract. One half "H" sized Co2 bottle is a 75$ deposit so it is in your best interest to make sure you get your money back. More as it develops.
