He followed every set guideline under the rules of engagment. He acted in total compliance with the Uniform Code of Military Justice. After reporting the incodent to his superiors, he was found to be in the right and was not immediatly charged. Not to mention, how in the hell can you commit premeditated murder against 2 people when you had no fucking idea the situation would ever occur in the first place? Just an fyi. The inital hearings are conducted by the Judge Advicate Generals office. If the JAG office finds the prosecution has grounds and evidence enough to proceed to a general court martial, a jury of 9 peers is chosen by the JAG Prosicution and the JAG attonery assigned to defend the accused. The jury panel comes back with a recomendation only to either convict or aquit. It is the Judges final descision if the person is actually convicted. Under normal circumstances, the judge is actually a panel of 3 judges in a capital offence that could result in the death penalty and 2 of the 3 must agree on the conviction and sentence. Yes, I am speaking from first hand knowledge. I served on a jury panel during my 8 years that I was in the US Army Special Forces. I was also awarded a Presidential Service Award by Presdident George Bush Sr for doing the exact same thing in S. Korea while on duty in Panmunjon on the 38th parrell. The only difference was the guy I shot and killed had a WW II M-1 Carbine. Later it was discovered it did not have a firing pin or ammo in it. I can't say he'll get off. He should but this is the military and strange shit happens all the time. If he is convicted, I don't want to even thing what'll happen. |

Well I got news for them it is their fault because they wont allow the American Fighting Man do what he was trained and is paid to do. My opinion "Fuck The Goverment!". There is definatly something wrong with this mentality. Actually from my undersatnding the Rules of engagement are not the same in a face to face confrontation. The "Do not fire until Fire upon" does not hold true in the way this was discribed. In this "Clearing" of the house this was a clear and present danger situation where they are allowed to protect themselves from a "preceived danger". He reported it and was backed up by his solderiers that there was a danger even if after the fact there was not a weapon. Frank can you tell me if I am totally up side down on this? |

Not that it will do much good, but I'm writing to the CMC with my not so humble opinion. I hope I'm not the only former Marine grunt that does. This is a piss poor way to treat a decent Marine.
