He'll be exonerated. Tried before a jury of his peers, there's no way ANY of them would convict him. More smoke and mirrors...  ::)

There is no jury in a court martial...

if its not a court martial, then there isnt a jury in the U.S. that would convict.
 Ya, great message ....Hey Join the marines and serve your country, just be carefull not to shoot anyone...heh, specially in a war zone.

This story is more than a week old.  [smiley=huh.gif] I can't imagine it not being all over the news or that Larry King wouldn't be interviewing everybody and Saturday Night Live having a field day.

NY Times and Washington Post say this began on the 11th or something. You have to wonder WTF is going on.  Looks like someone he knows turned him in.

Very shitty deal in any case. What a horror story   >:(

Damn if this was the case then my husband would have been convicted in Korean.  Rather he got a presidentail comendation. (know I spelled it wrong but typing fast.)

I can not believe that anyone in thier right mind could of brought these charges against him. He followed every set guideline under the rules of engagment. He acted in total compliance with the Uniform Code of Military Justice. After reporting the incodent to his superiors, he was found to be in the right and was not immediatly charged. Not to mention, how in the hell can you commit premeditated murder against 2 people when you had no fucking idea the situation would ever occur in the first place?

Just an fyi. The inital hearings are conducted by the Judge Advicate Generals office. If the JAG office finds the prosecution has grounds and evidence enough to proceed to a general court martial, a jury of 9 peers is chosen by the JAG Prosicution and the JAG attonery assigned to defend the accused. The jury panel comes back with a recomendation only to either convict or aquit. It is the Judges final descision if the person is actually convicted. Under normal circumstances, the judge is actually a panel of 3 judges in a capital offence that could result in the death penalty and 2 of the 3 must agree on the conviction and sentence.

Yes, I am speaking from first hand knowledge. I served on a jury panel during my 8 years that I was in the US Army Special Forces. I was also awarded a Presidential Service Award by Presdident George Bush Sr for doing the exact same thing in S. Korea while on duty in Panmunjon on the 38th parrell. The only difference was the guy I shot and killed had a WW II M-1 Carbine. Later it was discovered it did not have a firing pin or ammo in it.

I can't say he'll get off. He should but this is the military and strange shit happens all the time. If he is convicted, I don't want to even thing what'll happen.

I am so glad that Politicians and the media know the best way to fight a war. All these "Arm Chair Generals" in command of our troops. They all talk about how "Iraq is turning into  a quagmire". Well I got news for them it is their fault because they wont allow the American Fighting Man do what he was trained and is paid to do. My opinion "Fuck The Goverment!".
Wasnt there an old song I am not sure but went something like this "looks like a revolution".

What so they will let this man fry so that the President can keep good contract with the people of Iraq????  There is definatly something wrong with this mentality.  

Actually from my undersatnding the Rules of engagement are not the same in a face to face confrontation.  The "Do not fire until Fire upon" does not hold true in the way this was discribed.  In this "Clearing" of the house this was a clear and present danger situation where they are allowed to protect themselves from a "preceived danger".  He reported it and was backed up by his solderiers that there was a danger even if after the fact there was not a weapon.  

Frank can you tell me if I am totally up side down on this?

If they don't don't drop the charges on that poor fuck, then something has gone way south in my Marine Corps.
Not that it will do much good, but I'm writing to the CMC with my not so humble opinion.
I hope I'm not the only former Marine grunt that does. This is a piss poor way to treat a decent Marine. Even if he is an officer.

8 year Jarhead here and damn proud of it. Fly my colors daily! It is a crying shame this Lt. superiours and the comadant are letting this go to a court martial. Chesty Puller is crying in his grave.

Having had the extreme displeasure of being a witness in TWO courts martial, I can honestly say that I hope it doesn't go to trial, because from my experience, the government hardly EVER looses.

Bush and Company like the big picture only. They don't care about GI's. They cut veterans medical benefits and the like regularly... I'll never get that they don't take a real beating for this.
