Title: Some Advice Needed.. (not ch) Post by Bethany1 on Dec 4th, 2004, 2:33pm Ok, here goes. You all know I got married a couple of months ago... well we had our whole wedding video taped. The video/pictures were from the same company. The pictures we weren't too happy with so we were anxiously awaiting the video. The guy called from the video place and told us he accidentally ruined the video. So, I was pretty upset. He said he had the whole reception but he lost the whole church. So, naturally I cried like a baby, but thought well at least there is something left. Well, we got the video last night and watched it. Its the very end of the reception. No first dance, no father/daughter, no mother/son, no cake cutting, no best man speech. So, he lied. Well, Chris went there today and the woman at the place said, "well, we give you your money back, but thats all we can do, Beth needs to get over this because things happen in life".... Can you believe that?????? Fucking bitch. Anyways, Do you think I should contact a lawyer? I know I can't get the day back, Ill never get it back, so what I want is... all the pictures, and the monstrosity that is left for a video, and the $3600 I have already paid them. I mean, what are my memories worth? I am just so aggrivated. Any suggestions? :-[ |

Title: Re: Some Advice Needed.. (not ch) Post by Donna_D. on Dec 4th, 2004, 2:48pm Sue the bastard...add in some money for mental anguish/pain and suffering...take the cash and go on a second honeymoon to Vegas... Get remarried in a hot tub by an Elvis impersonator and have some video taken of that....I know, not exactly the same as a church wedding...but it WOULD be lots of fun! :D You won't ever get your actual "wedding day" on tape, unfortunately....but you do still have your memories and the still photos. Maybe you could have someone put together a slideshow of the stills you have and set them to music? Sorry for your loss, just try to make the best of it. DD Modified to add...I don't know what the dollar limits are in your state to sue someone in small claims court...5 grand is about the median amount...save the expenditure on a lawyer...take them to small claims court and sue them up to the limit...you should win. |

Title: Re: Some Advice Needed.. (not ch) Post by Gator on Dec 4th, 2004, 4:19pm So are they giving you ALL your money back or just the money for the video? I never had a "professional" take wedding pics, so I don't know what the going rates are. Best thing you can do is follow your heart and your conscience. Do you think it is worth sueing over? Is this going to help the next person to deal with this company? Will that make you feel better in the end or worse? Sorry you had suck a sucky photographer. I like Donna's idea. Take whatever you get and do the whole Vegas - hot tub - Elvis thing and get it on video. It'll never replace your actual wedding day, but think of the memories and the smiles later on down the road. Whatever you do, make a choice and then let it be over. If you dwell on it, it can cause problems in other areas. Gator |

Title: Re: Some Advice Needed.. (not ch) Post by OneEyeBlind on Dec 4th, 2004, 4:56pm I don't know. I've gone through life getting pooped on, but never suing. I think the reason that prices are so high today is because the minute something goes wrong ...... it's a law suit. I say live & let live. After being married for 25 years, I can honestly say, I've looked at the few wedding photos we have perhaps a dozen times ......... I look at the husband I have instead about a million times. Do what you think is right and you will never have to look back. |

Title: Re: Some Advice Needed.. (not ch) Post by nani on Dec 4th, 2004, 5:22pm I would suggest that first you tell the photographer that you want the pics and video and a refund. See if they agree or offer something you can live with. If not, small claims court and a BBB complaint is in order. There was a time when all you could get were stills, so even though you're out the video, pics are a great memory also. |

Title: Re: Some Advice Needed.. (not ch) Post by john_d on Dec 4th, 2004, 5:28pm When I was 18 I bought a Ford Tempo, a real beauty of a car ::), but the guy never produced the title for the car. When I returned the car he said I was not going to get all my money back, I called the tag agency, I got passed around until I got a hold of someone who could help me. I guess they called him because he called me back kissing my behind, both cheeks ;;D You may not need a lawyer, try calling some folks first. It's amazing how quickly a small business like that will crack with a little pressure. ;) |

Title: Re: Some Advice Needed.. (not ch) Post by Bethany1 on Dec 4th, 2004, 6:00pm Hey guys, thanks for the advice... Johnny, can I borrow your boot?? The place is called Lincoln Studios in Malden, MA. DONT EVER GO THERE!!!!! I was just talking to my mom about everything. She said to wait, see what they offer, and then if they give me a hard time SUE. I am going to contact a lawyer on Monday and see what they say. The company itself does a lot of work for the city I work in and I have already spread it around city hall that they sucked, so maybe that will have some effect their business. They should NOT be doing wedding photos or videos at all. What about the next young unsuspecting couple? I just can't believe the audacity of the woman... 'Tell Beth to get over it, things happen in life"..... is she serious? I mean.. is it me? Because if I ruined someones most important day of thier life, I would be bending over backwards, apologizing, and just being kind to the ones I have hurt. Im really starting to hate people I tell ya. Anyways, thanks for advice. Vegas is looking pretty good right now. (if I get my $$ back) |

Title: Re: Some Advice Needed.. (not ch) Post by ckelly181 on Dec 4th, 2004, 6:19pm Wow - that's sucks, Bethany. I tape and edit a lot of wedding videos. It's hard to believe that could even happen! A true professional would run equipment checks, have back-up cameras, batteries, etc. If that ever happened to me, I'd apologize up the wazoo, and give all the money back - probably leave town!!! Hope you get your money back - not the same thing as your pictures, but it's the LEAST those jerks should do... Chris |

Title: Re: Some Advice Needed.. (not ch) Post by stevegeebe on Dec 4th, 2004, 7:02pm You got the pictures. Maybe they are not so bad. I would not be pleased at all about the video screw up. But what is your motive with regard to legal action? Is it to make certain that this will not happen again to those who follow? Anger has a corrosive effect that money rarely repairs. Look around at all that you have and celebrate. May you and Chris, way into the future, look back and barely remember this because it has been pushed out by all of the great times y'all have had along the way. Steve G |

Title: Re: Some Advice Needed.. (not ch) Post by Biker on Dec 5th, 2004, 8:58am Talk with the photo/video company first. You go dragging in attornies, judges, and taking up taxpayers money, things could very well become time consuming and very expensive. Those dayumm attornies can ask for a continuance dozens of times. So there ya are, taking a whole day to go to court, pay for parking, sit in the courtroom, only to find the opposing attorney isn't ready for this case, and asking for a date in the future. I personally know some scum sucking attornies, and that is one way they drive the cost up. Something like that could go on for years. Perhaps a small claims court would be your best bet. Something like Judge Judy, or Judge Joe Brown. Not to be funny, but those folks have a nation wide adudiance and have to do things correct. Local judges can be swayed by how they feel at the moment, not to mention the pay-offs that go on behind the chamber walls. Talk with the owner of the company first. |

Title: Re: Some Advice Needed.. (not ch) Post by minnie on Dec 5th, 2004, 9:52am Bethany, I am so sorry to hear about the loss of your wedding tape and photos. Not only do they need to get rid of the photographer but also the uncaring lady they have speaking for them. A possible suggestion that I know won't replace the video and photos but may help.!st-when you get the money back or before buy a camcorder.ask people at the wedding if you can get a copy of pics they took.you may even be able to redo yours and the girls because they will still have their dresses and yes maybe rent him another tux.As you record any pics you can get maybe play in the back ground the song you and your husband and you and your Dad danced to.Sit down in front of the camera and say your fondest memories and maybe ask the families and wedding party don't forget grandparents. The video will warm your heart in a different way and your children will get bits and pieces of your wedding day.It may be interesting to hear trhe different thigs about your wedding day from a different perspective.this won't bring it back and it's alot of work but just a Idea. we had friends tape ours 2 cameras running the same time and then they stopped halfway through the reception. No cake, bouquet throw but I'm grateful for what we got.I really hope friends and family got good photos.they can be a big help. O.K. I'll stop rambling now Minnie |

Title: Re: Some Advice Needed.. (not ch) Post by EmpressJMB on Dec 5th, 2004, 12:24pm Bethany, I can relate to this as our photographer ruined ALL the photos from my wedding. I did get most of the money back from him and pretty much ruined his reputation by word of mouth. It wasn't so much the money but the lack of having any pictures. My family put the word out to all the relatives and they had enough photo's to put together a pretty nice photo album. 18 years later, I don't even miss them. Good Luck! Janet |
