Title: QUESTION
Post by Maria_Scala on Jun 23rd, 2004, 2:23pm
Have you heard of any CH sufferer being able to stop working and go on permanent disability?  About 5 years ago I worked with a lady that suffered from chronic migraines and she was able to go on disability because of it.

Just wondering.   [smiley=huh.gif]

Maria,

I believe there are a few Chronics that are on disability. Maybe one will post later.

I'm gonna find out, although I did not just STOP working.

The company I worked for put me on medical leave and told me I COULD NOT come back to work without a doctors written assurance that I would not have any more attacks and/or that the disease would not affect my ability to do my job.  No doctor can do that, therefore, here I am.

I got notified by mail June 10th that if I did not return to work by June 1st, they will consider me to have quit voluntarily. Huh?  I went to the State Emlpoyment office, they said I was not "employable" because of my condition, and therefore could not draw unemployment.

I had my appointment with the Social Security Office this morning.  The lady was very nice, she said 90 - 120 days for a decision.

In the mean time it is off to an attorney to see if the company I worked for can actually DO that.

Good Luck if you try it.  I have heard it next to impossible to get on the first try and not much better chance on appeal.

Anyone else?

Gator

Wow, that is precisely what Horseshoe Casino did to my father 3 years ago.  My dad would not pursue any legal action against them.  Lawyers said they felt he had a case, but none of the local ones were willing to represent him.  He is on permanent disability now, which adds up to jack shit.  Jack shit is better than nothing I guess...

Check out FMLA (family medical leave act). Don't know if it would help as I am not up on the details, but check it out. I know a few folks who used this when they needed to be off work for an extended time due to surgery.

Maria,

I was put on Medical leave for two months when I was first diagnosed due to the variety of meds they were trying, but I'm a work-aholic and hate staying home for long periods of time.  It was the company's decision and had nothing to due with disability.

day time TV in The Netherlands sucks.

Cheers,
Juvy

Thanks for your responses.  I honestly didn't think it would be easy, but I'll look further into this.  Thanks again.  Hang in there guys!

Chronic hear as well, the disability thing in Oklahoma is sort of a joke, twenty years of medical history ignored by the state and they ordered me to go to their neuro and to a psychiatrist. According to them I’ve been faking all these years, o well on to the next appeal. Almost three years wasted at this point.

I applied for SSDI due to ch and depression that goes along with it.  I was awarded SSDI the first time I applied.  However the reason they listed as to why I got it for was depression not ch go figure.  I had been chronic for over 2 years getting hit 8 times a day every day for 1 1/2 hours at a time durring working hours.  Plus I had tons of ER visits to back up and 4 neuros to confirm diagnosis.  I think they didn't like my wording of cluster headaches.  Maybe if I would have put migraines down I would have then got it for that.
