Have any of you guys/gals, who have teeth gone, hysterectomies (sp?), sinus surgery, and all the other horror stories of misdiagnosis, ever pursued malpractice suits?  Just curious. [smiley=huh.gif]

No, but I have used the threat of one many times to get them to stop billing me, It has worked on many occasions.

It just seems to me that some medical lawyers would be chomping at the bit to represent some of us.  I mean, we're not talking hot coffee on your lap here.

be told that 'no that won't work' or 'no O2 is too dangerous!)

no point in my view, the docs were wrong, they didn't know any better than I did.

No, but the thought crossed my mind after the horrific Paxil dependence that stole a month of my life.  Damn misdiagnosis.  Now I just watch the class-action lawsuit with mild interest.

I threatened to sue the dentist once. They fixed the problem so I didn't have to go through with it.

I tried . . .where I lived, the courts were in bed with the doctors, so I was a loser . . .it didn't matter that the doc botched my surgery, made it so I needed another surgery just to survive, had to have a home health nurse for more than a month, couldn't work for 6 months . . . .it goes on an on . . .It was so bad there, that a family just north of the city only received $100k for the death of a family member due to medical malpractice . . .

I have about 30 non disolving stitches in my stomach out of 300. Apparently the doctor claimed that when they ran out of disolving thread they mistakenley used the non disolving by accident. I didn't find out because of pain, I found out during and x ray for broken ribs about a year later.
I spoke with the doc and he says leavem they won't hurt anything. So there they're stayin I guess. I admit I was a little pissed, but the guy did an awesome job on fixing me up. Life over limb I guess. I would have a hard time sleeping if I sued him for doing the best he could do with what he had to work with. I was pretty messed up when I got there, and I'm still here to tell it.
However it sounds like it would be a winner to me.

I wanted to go after a particular nuerosurgeon once upon a time (and still would like to cross paths  ;)) but the lawyers told me that when you sign the release forms you're giving them permission to do what they can and if they fuck it up then oh well, their bad.
Unless it's cut and dried you'd better have some deeeeeep pockets to take Dr's to court.

Well the only brushes with malpractice concerning clusters, I chalk up to ignorance which simply caused me needless years of excessive pain.  Ignorance by my doctor and contributory ignorance by me, depending only on the knowledge of a dr and neuro.  Things have changed.  I expected more from them I guess, but I blame myself for not knowing better than to stupidly come and go on this board through the years.  Thanks everyone here for helping change things.

Dunno if this counts or not but my mom went after a surgeon and  hospital............3 million dollar lawsuit cuz the lawyer of course gets a third I think it was or more. This lawyer only took cases he could win. But......they lost and took about 5 years for the suit to go to court !!!! That was 5 years of stress and anquish for my mom......she caught on fire dureing a caterizeing procedure (spelling) on her face for melenoma spots. They had oxygen taped to her chin.......duh.....um.......scuze me ?? Boom !!!!! Jury couldn't see themselves suein a hospital that is there to help people......even tho the procedure they did on my mom was NOT safe or cool. She suffer'd burns and lost eyebrows and lashes......some fire flashed down her throat too and burnt areas of her eyes. Ruin'd most of the reconstruction being done the past year on her nose too. Opps I burned my patient Pam

Malpractice what it does ....is cost the Doctors more in insurance, that cost then comes to us, and our insurance goes up. Don't help a thing.

Problem is there are no physical or lifestyle issues that can specifically be pointed at and say this IS the cause and no cure that has been found yet.  Unless the doctor gives a written guarantee that the procedure will cure the disease (and none do), how can a court hand down a ruling of any kind?

No, I wanted to sue the oral surgeon who removed my wisdom teeth - he messed up my jaw. But it took me several years to learn it was malpractice, not just a normal risk.  And too much time passed by then.

The first doc who saw me for clusters wasn't wrong in diagnosing a sinus infection - I had problems there, and (coincidence or not) the headaches went away the second day on antibiotics.  Then I moved.  And moved again in a few years.

More recently, my GP wanted me to go on Paxil - was convinced my diarrhea and panic attacks were due to nerves.  Both problems dissappeared when I did a food diary and found that no fructose = no problems.   No lawsuit because I didn't take his advice, which seemed obviously wrong.

I agree with the sentiments here and Gator said it succinctly. It would probably be treated like epilepsy. A very tough thng to work on. All they can do is do their best.  

Actually, that this message board exists might even shore up their defense.......don't ya think?

Thought about it and still think about it when it comes to Dave and CH and my kids. But we cant afford higher bills from the insc. com. so I leave it alone. Unless I see the doc gettin in his car..............have baseball bat will travel............HEHEHEHEHEE Done it before and Ill sure as hell do it again. Of course what Dave dont know wont hurt him either.  ;)  I dont get mad I get EVEN!!  ;)

Might could I reckon, also might could weaken a defense if the information contained herein is public and the doc refuses to treat the condition and/or ignores his obligation to use the knowledge available. Regardless of his schooling.
In any event, Elaine is correct....only gonna cost us more in the long run.

We lost a little boy (my grandson) due to a doctors neglect.  No question about it.  Several validated screw-ups.  Numerous records lost, visibly changes in medical records, etc.

Justin was born (an identical twin) as a 6 month preemie.  His problem list was longer than your arm, from cerebral palsy to a shunt in his head due to hydrochepalis (sp) from brain bleeds due to the pressure on fragile arteries when engaged in the birth canal for 1 hour and 32 minutes waiting for a first pelvic exam..  Born with no life signs for 10 minutes, and revived with no Apgar score.

After numerous appointments with laywers whose specialtys were malpractice, and statements of "no doubt this was neglect on the docs part", and the survival of his twin who is now an honor student and football player, the case was dropped after 16 months.

Little Justin lived and suffered every second of his 8 months of life, when he eventually died of shunt failure.

Sure, his life would have been one of constant pain and suffering and he is better off now in heaven......but he didn't have to be damaged in any way in the first place.

This doc continues to practice.  Last I heard, he had blinded a baby with a needle performing an amniocentesis.  Oops.
