Criminal behavior by the company and the doctors they bought or rented. But the $400 million penalty wasn't too severe for a company that was bought for $120 billion in 2000. Just the cost of doing business. The scariest thing was one doctor describing how they would lie to create 'a buzz' about neurontin among doctors. The buzz took on a life of its own and kept spreading. |

Well, in this case, they were marketing it for uses where it had not been proven. The law lets doctors use a medicine for "off label" purposes if they think it will help. The unethical conduct and legal violations were related to the fact that the companies cannot legally market a drug for off label purposes, and they cant lie about a drug being helpful without studies to prove it. No one is disputing that both neurontin and topomax help some people with some conditions, and both have side effects. |
