JANUARY 10, 2004. The BUSINESS WIRE has released an article about a new gene patent. Elixir Pharmaceuticals has won it.

The patent, get this, “covers the discovery of a defined region on chromosome 4 that is implicated in conferring extreme human longevity.”

Elixir states, "The issuance of this patent and our identification of a specific gene capable of modulating lifespan underscore the success of both Elixir's licensing strategy and our internal discovery efforts.”

You mean THEY own a part of YOU that they think controls your lifespan?

THAT’S RIGHT.

Believe it, don’t believe it, it just happened.

In fact, it’s been happening for quite some time.

And what, pray tell, are the implications? Well, for example, if at any time in the future Elixir develops treatments that involve tinkering with this region of the body, you will, if you want those life-extension treatments, have to pay an ADDITIONAL licensing fee to the company, PLUS doctor’s costs.

It’s called THE OWNERSHIP OF LIFE.

It’s not a Phil Dick novel, it’s for real.

As background, here are two articles I wrote and posted on the subject.

WEDNESDAY, MAY 23, 2001. Wil Hylton won't get a Pulitzer for his article in the June Esquire magazine, but he should. It's a killer.

ADD: The title is, "Who Owns This Body?" Hylton starts out with the story of a man who had his spleen removed because he had a rare form of leukemia. Years later he discovered that the UCLA doc who took it out had saved some cells and had used them for research. The doc also patented the cells.

ADD: In 1984, the doc sold the cells to a company, Genetics Institute, for stock worth $1.5 million.

ADD: Outraged, the patient sued. Eventually, the California Supreme Court decided against him. His cells were not his own. Why? Because the doc had a patent on them. It's called circular reasoning, and a demented bullfrog in a swamp would be able to see it. But not the black-robed morons on the CA Supreme Court.

ADD: It gets a lot worse. Hylton then sweeps into a narrative about the BRCA1 gene, which supposedly is the gene for breast cancer. A company in Salt Lake City, Myriad Genetics, owns the patent on it.

ADD: Therefore, if a woman wants to see if she has this BRCA1, she has to pay for the office visit to her doctor plus a $2500 fee to Myriad Genetics. Even though the gene, if it's present, is in HER body.

ADD: About 1000 other genes in the human body have been patented. Also the blood within the umbilical cord. And the stem cells in bone marrow. So if you want to get any of these items tested, you'll have to pay a fee to the owners.

ADD: Hylton writes, "...a patent issued in 1995 to the US Department of Health covered the cell line of an unsuspecting member of the Hagahai tribe in Papua, New Guinea...Other patents filed by the US government at around the same time covered indigenous people from the Solomon Islands and from the Guaymi tribe in Panama." Gives new meaning to the phrase YOUR GOVERNMENT OWNS YOU.

ADD: Other companies have filed for patents on "hundreds of thousands of DNA sequences over the past five years, mostly on random patches of DNA that may or may not even contain genes."

ADD: Hoping to score a big hit on some gene that causes some big disease.

ADD: Read the article--I strongly recommend it.

ADD: As I've been writing for years, the aim of major corporations--and governments too--is the ownership of all life. Literally. It's not just profit. It's legal and incontrovertible possession.

ADD: Courts are backing up this takeover. Author Hylton cites several other key cases that will make your blood boil.

ADD: In a sane world, a man would appear before a court and say, "You honor, this doctor has patented my cells without my permission." The judge would say, "A patent is legal possession." The man would say, "Then the patent is illegal because the doctor stole the cells. I had no idea he was going to patent them when he took them. "

ADD: The judge would snap to and say, "You're right. Cells were stolen. Patent was fraudulently obtained. Decision for the plaintiff. Case closed."

ADD: But as all concepts of private property erode, these judges can't tell their shoes from their credit cards. And in some cases, they're bought off or blackmailed.

ADD: I'm waiting for this one. A drug company makes a drug that is used to treat a so-called genetic disorder in Mr. Smith. Smith's doctor discovers that the treatment damaged 34 genes in Mr. Smith's body. Smith sues. But those 34 genes are owned by the very drug company who made the toxic medicine. The case is thrown out of court on that basis.

ADD: Therefore, I am setting myself up as the judge in the self-created Cosmic Court of First and Last Appeals. Parties to a civil dispute can apply to me for a ruling. On any matter. (Except mind-numbing familial disputes)

ADD: I will charge a reasonable fee, and the parties will have to sign a prior agreement to abide by my decision.

ADD: They will present their case in plain English, not in legalese, and I will render a verdict in plain English as well. I will use common sense, logic, and in no case will I make a final decision based on some technicality that obscures an underlying principle, such as outright theft of property or acting like a crazed idiot.

ADD: Both parties will have to concede that they are moral agents. Pleas of general stupidity, "just following orders," and "I didn't know what I was doing" will be ignored with prejudice.

ADD: No lawyers present.

ADD: Court is open for session, the flag is flying, and nobody owns any loose genes. Patenting of food seeds, genetically modifying said seeds, claiming ownership of transgenic animals will be viewed as signs of criminal insanity. Punishable by years of forced labor.

And then there is this article I wrote on a related subject:

MONDAY, FEBRUARY 18, 2002. Professor Jeffrey Hillman of the U of Florida is ready to begin human clinical trials of a mouthwash later this year. He is optimistic. He says this mouthwash has the job of stopping tooth decay for a lifetime. Hillman presented details of his work to a Boston meeting of the prestigious American Association for the Advancement of Science.

ADD: Presumably, the mouthwash only needs to be administered once. It contains a genetically altered form of the bacteria, strep mutans, which is said to the culprit behind tooth decay.

ADD: The genetically engineered form does not produce lactic acid. Lactic acid eats tooth enamel.

ADD: How they dream.

ADD: I recommend you pick up a copy of the February Harper's magazine and read Barry Commoner's reasoned demolition of the premises upon which genetic engineering is based.

ADD: Commoner points out that, in this murky area, data which contradict foundational ideas about genetic engineering are routinely ignored in the scientific literature.

ADD: The assumption that a single gene is linked to a particular trait of an organism is completely unreliable. Therefore, altering a gene or adding a new gene never guarantees that a bacterium or a human being or a food plant will perform as imagined.

ADD: Particularly when the altered bacterium reproduces, all bets are off for the next generation.

ADD: There is zero guarantee that the engineered strep mutans will continue to refrain from producing lactic acid. More importantly, no one knows WHAT the bacterium WILL do.

ADD: Will it kill gum tissue over the course of a year? Will it whistle dixie? It's a crap shoot.

ADD: In the same way, a crop of genetically engineered corn that is supposed to produce a toxin that kills insect pests may end up killing pigs that eat the corn.

ADD: The dream of genetic engineering was: Researchers could find single genes, each one of which would regulate a specific function. Therefore, an organism programmed with a new gene could be expected to acquire a specific new function.

ADD: This is not panning out.

ADD: The heralded Human Genome Project discovered that there were far fewer genes than supposed in the human make-up. (If we are to accept the sloppy work of the Project.) Scientists were rocked back on their heels by this finding. It seemed to mean that there were "too many human functions" to be regulated by separate single genes.

ADD: Therefore, genes were acting in concert, or genes were doing double and triple duty, or--who knows what? The whole idea of genes regulating functions in an orderly way started to crack up.

ADD: The whole idea that it IS the genes which determine these functions began to sink into a swamp.

ADD: Commoner suggests that DNA, which contains many genes and has been thought to be the master key for human functions, is not the origin for all this. Instead, proteins come first. Proteins form DNA.

ADD: Scientists in the field are well aware of Commoner's criticisms. Most of these researchers choose to ignore what he and others are writing. It's easier that way.

ADD: But what about the torrent of food crops which are now genetically engineered? What will those plants produce in a hundred or a thousand generations? The truth is, no one knows.

ADD: Corporations like Monsanto which want patents on all food crops (because these crops are now their non-natural engineered "property"), storm ahead in their desire to own all life. What that life will be like is unpredictable.

ADD: One main idea behind "free trade" and GATT and the WTO is: No nation can refuse to import genetically engineered food crops from another country. To refuse would be a negation of the "free" part. Such a nation would be liable for billion-dollar fines.

ADD: This hidden program is moving forward. There are large hurdles to be overcome, but the enforced importation of engineered food is high on the agenda of those who want to own the life processes of the planet.

ADD: As I keep writing, slavery is easier to impose when no one understands what freedom means anymore. In this case, "free trade" eliminates CHOICE (to trade or not to trade) and makes "free" mean: YOU WILL CHARGE NO RESTRICTIVE TARIFFS ON THE PRODUCTS YOU IMPORT, AND YOU WILL IMPORT WHAT WE SAY YOU HAVE TO IMPORT.

ADD: Sure. Free. I knew that. Everybody knows that. Everybody knows what freedom means. It means connecting the word "free" with anything under the sun and shoving it down people's throats. Like war. Like removing the Bill of Rights, piece by piece. Like blind loyalty.

ADD: But not to worry. Take two mouthwashes, and two engineered soy cakes, and call me in the morning.
