Title: FMLA discrimination... Post by nancyc on Apr 1st, 2003, 10:42am has this ever happened to anyone here for chs? i went out on FMLA for five months until they found a medication to work for me...i am trying to transfer from one job at the state to another..i got the new job and then my witch of a supervisor that does not want me to transfer talked to my new supervisor..she told me she was concerned that my rating was down as i was out of work on leave without pay for five months..i explained this was FMLA..how can they put this on my record? thanks for any info..smiles,nancyc |

IF they do (and they did), and you can find a way to verify this, then contact the FMLA and you may find that your supervisor have bitten of far more than he/she can chew.. As a supervisor myself I can see their concern, but since I am on FMLA I know that if I voiced such a concern in public; not wanting to have a certain person moved to my team because of to much abscence - and knowing that this person was on FMLA, then I would be getting into really deep water. FMLA is a Federal program that is in place for the single purpose of protecting employees when a medical emergency arises. To use that against an employee is not good.. But, as you know, a Company / Agency can find ways around not promoting (etc) an employee - in your case they were not to smart since they obviously brought up their reason for not transfering you - once the reason has been given and it pertains to something covered by FMLA - then it becomes descrimination. Talk to the FMLA people - see what they have to say. Marty |

It may be on Trenholm if I am not mistaken. Anyway, it is right there near that intersection.... They will DEFINITELY give you the real skinny on that stuff. And it is free. Do it. I've known some folks who have used them and they do not play. It is like the ACLU, but with even more nastiness.... B |
