Title: ....getting sued.. Post by Roxy on Mar 1st, 2003, 12:33pm My morning can't even begin to compare with Mark's bad day. There has been no danger to life and limb....but I still want to rant and rave here. Maybe I'll feel better, and my temper will calm down. Nasty night with the head last night. Only three hits....but, they were pretty uncomfortable ones, no need for descriptions...ya'll all know. My youngest son called, he was staying the night in town at his fraternity house. Woke up to the sheriff banging on the door....groggily trying to get to the door, my daughter beats me to the door....I hear the sheriff say "I have some bad news.....", I start panicking, thinking something has happened to my son....Whitney just starts crying...thinking it's her brother....major adrenaline flowing….sheesh. Well, my &#%*$)_@ neighbor had shot one of our dogs. The dog had roamed over into the neighbors pasture....the damn neighbor couldn't even do it right and shoot him properly....he just left him in pain and shredded. We do shoot dogs out here that attack and bring down calves.....my dog was just chewing on one that had been dead for a couple of days...that's what dogs do. This same neighbor also poisoned my rottweiler last year. This man is a townie who moved to the country, and doesn’t have a clue. So…..I call my oldest son to come out and help us get the dog loaded to go to the vet (none of us had the heart to finish him off), the dog is in pain and very heavy, we have to muzzle him because he’s hurting so bad, when dogs are hurting, they don’t like to be messed with….well, he bit the hell out of my son. We’ll just make it a multipurpose trip to town….vet….ER…etc. My friendly neighbor just left my front porch after telling me that we are going to be sued for the loss of the calf, damages, and mental stress. Trust me….by the time I’m through with him…..he will be justified in suing me for mental stress. My son has already said he’s going to go write something with Round-Up in the guys nice, pretty front lawn. Well, it’s just now noon…..can’t wait to see what the rest of the day brings……LOL Wish my husband was at home…..sheesh. I said this story didn’t involve life and limb…..but, it might involve my neighbors life and limbs (if I can just figure out how!) Rant over....sorry! :-/ Tracey |

Tracey, sorry to hear about all the crap you're going through right now. It seems like sometimes everything just hits at once and you just want to scream "ENOUGH ALREADY!!!". Hope things start looking up soon. Was the vet able to do anything for the dog or did he have to put him down? I'm so sorry! I really hate those types, the townies that move out the country and think that whatever they think is best. We always seem to have a new group moving out here and complaining about the local gun club. I mean, the thing has been here since before I was born and THEY moved next to it. Ironically, the townie may have stepped over the line by NOT killing your dog...shooting the dog and allowing it to suffer might be considered animal cruelty...check out the law in your area and maybe you can remind him of this next time he threatens to sue... OR, seeing as how you live in rural Texas, you may may just want to follow your neighbor down to the bar some night, and then you tell all the good ol' boys in there how your neighbor shot your dog but didn't have the decency to finish the job, just let that poor animal suffer.... try to leave before you hear glass breaking. -tommyD |

The best advice has already been given; shooting a dog and leaving him injured - that is a crime and should be reported. Let the word out as to leaving the dog like that (I'm sure that you already have), there may be some good old "street justice" ;D The problem is that once an "argument" starts in a country setting with country folks involved - they never seem to end even if something bad happens, so restraint dear Roxy, and sue him instead for the value of the dog and for the pain and suffering caused your son when taking the dog to the vet, including medical bills and lost time off work and whatever else you can through into a law suit. I live in Canada (Saskatchewan) (Farm and raise cattle) and if he didn't get a post mortem done on the calf here, he wouldn't have a leg to stand on. If he keeps this up he still might end up without a leg to stand on. My guess is he would have a hard time proving that your dog did anything but eat (just try to get paid insurance on a calf the coyotes take down... you almost have to have video!!) Post by Roxy on Mar 3rd, 2003, 6:40pm First, I want to thank everyone for their wonderful support....I've been a little stressed the last couple of days...and ya'll have made it so much easier. Now to the end of the saga: Faxed the papers off to my lawyer....he called and said he fell out of his chair laughing. The neighbor was acting as his own attorney (real stupid), he was asking for $500,000 in damages (for a nonexistent $500 calf, even more stupid). The lawyer just laughed and laughed....said don't worry about it....he was really going to enjoy taking care of this one. My husband called the neighbor from DC....don't know what was said in the conversation (not real sure I want to know :o), but three hours later I recieved flowers from the Found an 8 week old australian shepard....now my only problem is picking out a name! I may be a country hick......but, thank god my husband isn't....LOL |

If this guy would have had something like an AK-47, he could have blasted the poor dog into the next state and then you wouldn't have had to deal with the suffering animal. Mind you, if it was dark the AK-47 still may not have done the trick. Hmmmmmmm, perhaps a bazooka would have been best?? Oh the wonder of guns and the power to destroy at the tip of your fingers... Guns don't kill people. People kill people. Mr. Heston would have been proud...In the end, I don't know what I'm talking about, since I don't have the luxury of knowing what it's really like to have my neighbours shooting at things ( or people :-/) from their back porch.
