Title: Jury Duty
Post by GaryLA on Nov 7th, 2002, 1:51am
I am called for jury duty next week and currently in a cycle.  My Doctor refused to give me a medical excuse and told me that Cluster Headaches are not a recognized medical excuse for jury duty.  I couldn't imagine remaining in the jury box while the demon rears his ugly head.

Anyone have any thoughts or comments.

Thanks.

Gary

Rats. Sorry, but you'll get some good advice from others

I've never been called because of my epilepsy so I don't have experience, but if it's like here, it may not amount to a trial.  In my small town, people don't get called back for a year.

Perhaps someone there might have come across this horror before and have knowledge of this thing.  Others will no doubt have better ideas.

Bye the way your doctor is behaving like a prick.

Hmm.........Hi Gary and sorry your doc is being such a butthole.......perhaps time for a new one??

AND......if you really can't get excused.....well, let's just say that I would HATE to see you picked and up in the box of jurors and have an attack.

BUT THEN AGAIN.........THAT, my friend, would make for an interesting trial.

Imagine ppl actually being exposed to our hell in such a setting...............HMM..............THEN I bet, you could go back and smile at your doc the next time you're served jury duty papers........and he HAS to sign b/c Clusters ARE reason enough for medical excuse!!

Good luck, and wishing you pfdan also,
EDNA

Gary,

The only advice I can give you is to just be honest with the judge.  Really lay it on about how bad these h/a's are and how you need to give yourself injections (even if you don't) and be near your oxygen tank.  Hopefully, he'll just excuse you.
If that doesn't work, you gotta make up stuff.  If it's a case involving cops, say that you hate all cops, you've had nothing but bad experiences with them, you don't believe anything they say, blah, blah, blah.  They'll excuse you for that ! ;D
Wish I could be more helpful.

Agreed.  Talk to the judge and have your O2 tank by your side when you're talking.  Explain that you've not been able to get a cluster knowledgeable neuro to meet with yet, but print out some stuff from the website here - cluster traits, descriptions - anything you can think of and give it to the judge.  Explain that you can't be held responsible if you suddenly experience an attack and that there's NO WAY you would be able to concentrate on the trial.
You're in LA - how about emailing Doctor Kudrow to see if they could give you a letter?
Best of luck, Gary - I can't imagine how horrible it would be to be on a jury and getting hit.  Let us know the results, ok?

If the O2 and potential for injections don't do the trick when the attorneys begin choosing the jurors you will be able to figure out answers to their questions that will get you de-selected by them.
Good luck

you might won't to get a copt of a letter by simon bower   ouch uk rev. jan 2001     if you see your getting hit pass the letter on  to the judge. it will tell him what is going on with you! very good letter i keep one in my lunch box so if i get hit and have a boss that does not know i just give it to him and walk off and do my thing.it will save you a lot of time trying to tell them what is going on. hope things work out for you! wishing you pain free times!!!!!       ken b

I don't have any advice to offer about the jury duty, but if the person on trial has you on the jury I sure hope he or she didn't do something terrible, cause a CH'er in cycle under attack could sure sway a jury to a guilty-kill him verdict!!! LOL ;D :o

I think this is the first time we ever agreed ;D

Gary,

Your Doc must be an a s s h o l e !!!

My Neuro gave me a note a few yrs back that had just what clusters can do to a person and at any time.....I was out of there in no time flat ;D

Get a new Doc!!!

All I had to do to stay out of jury duty was explain completely and honestly the details about CH, my treatments, and the current situation of my CH.  Good luck!

I would suggest that you stand up in the middle and yell "I don't care what he/she did, hang the bastard/bastardette". Lawyers interview you before usually, that would be a good time. If questioned before, just say you hate when the voices in you head come out.

I agree with Margi's advice. I am sure the judge will be not interested in a potential juror that can't give 100% to the trial. Bringing the O2 can't hurt.  :) :) :)

"Unable to serve: If you have health problems, a paid vacation, or other personal commitments that cannot be rescheduled at the time you are initially called, a postponement may be available. If you have already received one postponement during the past 12 months, you will probably have to come to court and speak to a judge to further delay your service."

Hehe......gotta believe that when you fall to the floor in the jury box screaming in pain clutching your head and interrupting the trial, something tells me that you'll be excused pretty much immediately from further service. Might also be a great time to get CHr's a bit of court time so to speak.
I've been to jury duty and there is something about judges and interruptions that don't sit so well with them. don't worry too much about it.
