Thought this mite make interesting readin for someone needin a 'kick' ! This is a true post someone posted to a lawyer on his web site for advice....here it is: my fiance was recently convicted of 2nd degree murder after he attempted suicide with a gun and missed. The bullet traveled a ways and entered the house of someone else killing them. When he found out what he did he went into shock. His lawyer admits that he did nothing but sit and cry the whole time. The lawyer told us if he pleaded guilty he would get four years. He was told if he didn't plead guilty he would get life. So he plead guilty, the judge sentenced him to nine years. A lawyer we talked to said we had pretty much so been screwed over. Any advise on where I can look to find cases to help the appeal, maybe under mental instability, anything ? We want to fight this. Perhaps get in house arrest or at the least the four years the lawyer told us we would get. Lawyer's response: Easy. All you have to do is be a dufus high school dropout. He failed "Aiming 101". Now this guy was definelty havein a bad day.......can't hit the broad side of myself Pam

Not boring Pammy. First off, the guy's story about trying to commit suicide is not believable without backup history from a doc. The shooting of someone else is actually second degree because the prosecution knew it was hard to prove first degree but could lock in second. The cat's crying was not enough to sway any judge. They hear stories everyday, simply acting the part ain't shit. Where's the doctor evaluations. Also, what is his past history with the law? Was the gun registered? Second, he didn't pay enough for his lawyer for such a case. Never scrimp on a lawyer, get one that comes right out and shows you his track record in similar cases. Sounds like the lawyer had no case except the shooter's story. Never flies. Before I walked into a courtroom once, my lawyer came out and said, "You know the judge has six years in his pocket for you today." He told me not to worry though we've done all the right things, let them win on the civil forfeiture where they actually had no case but would cost more to defend, inturn for reduced charges. It's all about money, they wanted to cover costs involved in the investigation. I pleaded guilty, of course of reduced charges. Cost me tons but I walked out with added probation, oh yeah, I also violated my probation. Guilty, looking at six years and walk out with another year probation. That's a lawyer. All money up front, he's serious. You should have heard this lawyer talk though. I ate humble pie, lost everything but was free to start over clean. My lawyer still gets Christmas cards with gift certificates and continued thanks. Just sharing in case anyone happens to stumble some. The judge makes the decisions not the lawyer. Hard to make a deal for four years on that one, but if my lawyer told me I could get life on second degree, means new lawyer. Big hint right there. Nine years means he had no case, prosecution knew it. Pleading not guilty would not have been smart at all. I'm taking that this is not a pro bono case. Not guilty plea gets into six figures and he still loses, could get worse. Prosecution got nine years because this guy shot someone and his story is flaky. Slam dunk second degree. Lots of details missing. Kevin M
