Police Harasment

Angry Hello my name is John, I'm a cluster head sufferer for many yrs. now. Last night I was Harassed by my local Sheriff's Department and spent a few hrs, in a plastic cage, was refused my medication (VERAPIMIL) by the Nurse on call. I made many request to get my medicine before i was attacked by the Demon. Cry Wouldn't you know it, the demon found me. It was a 10 on the kip scale, and it took the cage kickers 45 minutes before they even came and checked on me.  ??? I feel that my rights as a disabled person should have applied do to this situation, but no it doesn't according to them. I plan on contacting my local news channels to see if they will listen to what I have to say about the treatment of disabled persons when they are locked in a cage.  When I finally got my meds. It was after they released me at 1 am. in they morning Smiley lucky enough for me someone or something was watching over me last night in that cage, because i'm still living!!!!
I would like to know if anyone else has been in this possition and would like to hear what you think. (good or bad)
thank you.

I never had an attack in lock up, but from the times I was there I don't remember them being too responsive to requests, LOL. I also remember many of my rights getting curtailed. THat's what happens when you're arrested. You lose some of your rights, and many more if convicted.
On a side note, being a few hours late with verap won't make it stop working, so that attack would have come on anyway.

Sorry you had a rough night, but I'm with Ted on this one.  Verapamil is a preventative, not an abortive.  I hope, if you do get media coverage, you don't tell them that the Verapamil would have prevented an attack for you.  We DO, as a group, need publicity but ....  Undecided

The ex-cop in me brings this out.

No need for you to answer just my own internal questions.

What were you doing to draw my attention in the 1st place?
First offense -- doubtful
Started by spewing off the 4th amendment -- Wrong move.  Now you pissed him off.
Detention cell -- no meds.  And you're surprised by this?  Prove the meds are for you.  Prove the rx is valid,  prove the dr is real.  Prove the meds in the container are really the meds described/named on the container. No way in the world they would have given you anything.  If they had you'd try to sue over that also.  If you try to sue over not getting the drugs you'll never get anywhere.

You got nothing!

I'm with the police on this one.

I am so totally with Echo on this one..

John, to bad that you became a "victim"  Lips Sealed

Suggestion for ya: If this happens again (you becoming a "victim"Wink, then in a calm voice explain that you have a medical problem and be sure that the meds that you are asking for are valid emergency meds. The cops (at least in CA) will have to check up on it - most jails have access to a medical staff - and if you told them that you needed Verapamil.. what do you think that the Dr would tell the cops when they checked..

By the way.. the plastic cage.. ???  ours are made of metal in CA..

Don't ya just love that 5th ammendment ;D

You will catch more bees with honey than vinegar is the rule here.

It sounds like you tried to challenge the police. They don't like that.

When you realize that you are no longer in charge of the situation, rule one is CALM DOWN. The reality is that you are going to jail so you need to asure your health will not be at risk while incarcerated.

Say nothing as to the offense you are charged with.

This is all hindsight. Lets talk about the future.

Now, to correct the "injustices". Have you called a lawyer?

If not, have you considered ACLU representation.  Local police departments LOVE the ACLU.

You might have a case of endangerment while in custody. I don't know, that will be for your legal beagle to figure out. But if you do, I would seek not only real damages, but also punitive damages.

In either case, get in touch with a reputable attorney.

I had a legal issue once, and decided not skimp with finding the bargain and went with a well known lawyer. He was expensive but the charges went away immediately after I met with him. It was well worth it.

Good luck.

This will be harsh, but I have to say it.  It's the teacher in me!

Next  time, keep your nose clean and you won't have to relive this situation.  I can't believe that the police would all of a sudden decide to arrest you, or even approach you, just for talking to a friend.  Life just doesn't work that way.  You must have looked suspicious or have been doing something you weren't suppose to.  As to your lawsuit/media attention thingy.... forget it!  Like Margi and Ted mentioned, verapamil is a preventative not an abortive.  You will only be giving us bad publicity, and we don't need it.

That being said, I AM sorry you got hit.  The beast knows no pity.

I am a former H.S. teacher and did my share of law enforcement so I must agree with Ann and Echo.
I'm not an attorney, although I'm married to one but do not play one on TV  Wink, but I'm not so sure the 4th ammendment applies when a officer places you in custody. He/she can check your pockets Cry for thier and your personal safety and it has nothing to do with your 4th rights. It's called a pat down; not  search.
If you don't have anything illegal in your pockets they won't find it now, will they? Just a thought Wink
About 10 years ago I got into a barroom brawl and was giving shit to the bouncers and cops UNTIL they told me I was under arrest. I shut up like a clam, said nothing and co-operated with EVERYTHING they wanted. [This also happened in the middle of my law enforcement days]. They were astonished and asked "Why?" I meakly responded that if I continued the charges would go from disorderly conduct to resisting arrest and assault. I knew when to STFU.  Lips Sealed
Moral of the story: If you really think you're innocent and your rights have been violated, then STFU, do as you are asked, and play the game.  Be cool. Cool Then you hire a lawyer, if and only if, you have a case against them. 9.999999 times out of 10 you won't have a case.
The most important piece of information to take from this, and this comes from my wife/attorney even for a traffic ticket, admit nothing to the police. You have the right to say NOTHING, so don't.  All you will end up doing is incriminate yourself or dig a deeper hole if you do not. That is called your Miranda Rights, so use them.

Of course, this is just my opinion. I could be wrong.
