I spoke to my HR department today and they said I "may" qualify for FMLA but I need to see a doctor within 15 days. I have a doctor's appointment Thursday. Do clusters fall under FMLA qualification?

As long as your doctor agrees it's neccesary for you to take time off, yes. The doctor will probably write something to the effect of "severe debilitating pain" as a reason you cannot work. If possibile, I'd have them include "inability to concentrate" and any other side effects of loss of sleep in case your nighttime attacks get worse too.

Yes I have had used the FMLA a couple times. I do not know what the 15 days is about with your HR department. Get the paper work from them and pre fill it out as best you can because sometimes doctors charge for this paper work. One more thing is that your HR department might try and set up your FMLA to run the 88 days or what ever it is now but this FMLA is designed to run the whole year or until you use the full time off. the only problem is that if you get hit and use it on monday but then dont use it again until the following monday it will only count as two days used. However if you use it on the monday and then again say on thursday they will count monday, tuesday wednesday and thursday on your FMLA. Good Vibes MYNM156

SI-- The 15 days is a standard time frame that employers give employees to return the completed FMLA documentation to the HR department. If the FMLA paperwork is not filled out and returned to the HR department within the 15-day timeframe, then the HR department can, by law, automatically and temporarily deny your claim at that time. Of course, you can appeal the denial simply by turning in the completed FMLA paperwork, I believe. Your employer is allowed the right to deny the claim if paperwork is not turned in within a timely fashion. Hence the reason why I always ask for any FMLA paperwork the day before or the day of a doctor's visit. It gives the doc plenty of time to fill the paperwork and return it within the 15-day window.
