Child-Rape Suspect, Illegal Alien Sought In Newark Killings

NEWARK, N.J. -- As police continued to search for additional suspects in the execution-style killings of three young people in Newark, the debate over the immigration status of one of those already arrested picked up political steam.
 
A city councilman announced Monday that he was introducing a bill to require Newark police to contact federal immigration authorities whenever they arrest someone living in the country illegally who is charged with committing a felony.
 
The bill is the first piece of legislation that has resulted from the horrifying shooting of four Newark college students, which left three dead and one wounded.
 
One suspect, 28-year-old Jose Carranza, was an illegal immigrant from Peru who was granted bail earlier this year when he was charged with assault and child rape. A status conference on the assault case was scheduled in court for Monday.
 
"He clearly should not have been out on the street," said City Councilman Ron C. Rice, who is sponsoring the new immigration measure in City Hall.
 
The guidelines Rice is calling for would change policy for law enforcement in the city.
 
Paul Loriquet, a spokesman for the Essex County Prosecutor's Office, told The Star-Ledger of Newark that the office generally refers cases of illegal aliens to federal immigration authorities only after the defendant is convicted and sentenced. Notifying authorities earlier might result in having suspects deported before they could be punished for their crimes.
 
The shootings have ratcheted up anger in New Jersey's largest city. The overall crime rate has declined, but the number of killings to date, 60, is nearly even with last year's pace of 63. The killings have prompted billboards in the downtown area that scream, "HELP WANTED: Stop the Killings in Newark Now!"
 
The four victims, friends ages 18 to 20, were shot Aug. 4 while visiting in a school yard not far from their homes Saturday night. The three who died were forced to kneel against a wall and shot at close range. Authorities have said robbery appeared to be the motive.
 
So far, authorities have arrested three people in the case -- Carranza and two juveniles -- and secured a warrant for a warrant for a fourth, Rodolfo Godinez, 24. Authorities say they are looking for additional suspects, but not have named any of them publicly.
 
Police spokesman Todd McClendon would not comment Monday on a report in The Star-Ledger of Newark in Monday's newspapers that two of the remaining suspects are juveniles.

I'm all for getting control of our borders and our legal immigration system.  But this case doesn't say anything to me about illegal immigration or illegal immigrants.  But I'm dissappointed that the legal system is granting bail to any 'child rapists' whatsoever.

Newark NJ Paying the Price for being a Sanctuary City?

The murder of 3 college students in Newark New Jersey last Saturday night proves that even in our society which has witnessed horrific acts of violence in its relatively brief history, we haven't lost the capacity for being shocked. As the perpetrators are rounded up, the alleged ringleader appears to be Jose Carranza, aka Jose La Chira. Carranza is an illegal immigrant from Peru who has been in trouble with the law in Newark twice this year.
 
Carranza was indicted by grand juries in New Jersey twice this year — in April on aggravated assault and weapons charges; and in July on 31 counts which included aggravated sexual assault of a child under 13 years old and endangering the welfare of a child he had a duty to supervise.
 
In both incidents, Carranza was granted and posted bail - a rarity according to Alan L. Zegas, a noted New Jersey defense lawyer.
 
"The level of risk of flight increases exponentially when a person is not a citizen of this country and has few, if any, roots here," Zegas said.
 
The prosecution in both those prior cases stated that "Our focus hasn't been his immigration status."
 
Perhaps the reason the Newark prosecutors focus was not on his immigration status was the fact Newark is a "Sanctuary City" - where local officials do not enforce immigration laws.
 
Paterson Councilman-at-large Rigo Rodriguez: "The residents of this city must be able to go to the supermarket, ride in a car, walk down our streets, without fear that they will be arrested and not be able to go home that night," Rodriguez said. "Immigration officials need to deal with illegal immigrants at the border. Their failure to control that is why they end up in our cities.
 
"Once they're here, it shouldn't be our job to deal with their immigration status," Rodriguez said. "Once they're here, they're members of our community and our role is to make them feel safe and comfortable here.  
They simply shouldn't be harassed."
 
Was the Newark prosecution or the judges on his prior cases afraid to consider Carranza's immigration status when granting bail? What role did Newark's sanctuary city law play in these decisions?
 
And finally, how did an illegal immigrant from Peru have the money to post $200,000 worth of bond? Even at 10% someone would have had to come up with $20,000 - a sum that an illegal immigrant would be unlikely to have.
 
Three young American students are dead and another grievously wounded at the hands of a murderer and his motley crew. While ultimate responsibility lays with the killers, there is no doubt that our system failed those kids in that New Jersey schoolyard a week ago.

What is amazing to me is how many border states have Sanctuary Cities and all the damn hospitals are closing because of it!
