Next will be your car. Then your home. But don't worry - the government is more addicted to the tax revenue than you are to nicotine.

Its called the free market. The government has the freedom to dictate how a restaurant or bowling alley does business and who they can have as customers.

| Amen and Blessed Be to that! It's a bone of contension here in my county as the board refused to just go along with the state wide ban. 2 times the county citizens have voted down a smoking ban referendum. The consperacy theorists blame the tavern league. Other side of the coin states the methodical reduction of citizen rights. Then there is the arguements over who's got the "right" rights. It's a muddles up mess.

Here in Oregon you have to be 25 feet away from any entrance.....like at a restaurant or bowling alley. Being outside isnt good enough, you also have to go more than 25 feet away from the entrance. Bingo Halls and Fraternal Organizations are the only ones left who can smoke.

One of the "Breathe Free" folkas stated that it is "Governments duty to protect the public...et al) Really? I thought this was a free country? I thought we had the inalienable rights to life liberty and persuit of happiness? Sure as long as Government says it's ok? Sorry, I just don't buy it. My Happiness doesn't come with a price tag that lets the state raise the "sin" tax 1.25per pack of smokes.

Here's my problem with all the no smoking laws (and watch the Libertarian in me come out now): Tobacco is a legal product. Bar and restaurant owners are private citizens who own private property. It should be solely the decision of the owner of private property as to whether or not he or she allows the consumption of a legal product on his or her premesis. If this doesn't work for all the feel-good, do-good politicians, then they should make tobacco illegal. They won't, because like I stated earlier, they are more addicted to the tax revenue than I am to nicotine. So much for what used to be America. It's now Amerika.

A few years back I was doing some intakes at a correctional facility. Went out to my car to have a butt and got surrounded by COs. Threatened to write me a ticket and tow my car if I continued to smoke on site. One guy had a gut so big he hasn't seen his feet in years. Apparantly twinkees are still allowed.

Move on down here to Kentucky. We will be the last of the states to bend. We make our living selling burley and dark tobacco. Although I think Lexington and Louisville have already passed a couple of your laws.

The thing about the no smoking laws is that the percentage of smokers is dropping rapidly and that it's also because that among legislators, the percentage is even less. If I remember, the national percentage of smokers is about 20%....that's getting lower all the time. Frankly, I'm not all that worried about second-hand smoke but I never tell people that because then I don't have to explain why I don't let it in the house. Guilt works for us. If we were to time travel back to the 1950s, we'd have to put up with smoking everywhere. Doctors offices, drug and grocery stores, theaters, everyone's livingroom, Greyhound buses, airplanes, and hospitals....my retired nurse aunt smoked on the job. Non-smokers were the oddballs when I was a kid. My dad had 18 employees at our parts stores....17 of them, including me, smoked. Charlie

| I know I am gonna get some heat for this, even as a heavy smoker, but I happen to agree with this law. Many times, I have noticed the HUGE cloud of smoke at the door to a place, because of all the smokers. NO one, smokers included, need to plow through that heavy cloud, in order to leave a facility. 25 feet is not unreasonable. Chuck

| On private property it is. It should be however many feet - zero or a million - the owner says it is. Remember, we're talking about a legal product being consumed on private property. Public property is a completely different story. How's that for taking some heat? You radical, you.

| I agree. When I had my office in Gladewater - I HELD the DEED and NO ONE told ME who could do anything in MY place. The city passed their little ordiance and MY place went on business as usual. I dared them to tell me anything different - my attorney had the paperwork ready to challenge that little ordaniance (and he doesn't smoke). It's just NOT right and people SHOULD challenge it. PRIVATE property is PRIVATE property and until they change the constitution that's the way it should remain. The OWNER should have the last word NOT the government! And for my part, I'd rather see a $1.25 tax on sugar than on nicotine. They'd make more money and maybe people would cut down on sugar -- it's worse for you than nicotine. check the diabeties stats. But people will eat their twinkies and get goo all over everything and then bitch about my smoking. I just don't see the difference. Hugs BD

| Precisely, dear Barbara. It would take two-thirds of the states to ratify that, and I doubt the removal of such a fundamental right would be agreed to by so many. However, it is at least a possibility, and that's why I continue to practice my marksmanship. A move like that would cause the second American Revolution. Despite it, the federal government continues to peck away at the body America - it's like we're being pecked to death by ducks. One here, one there, people say "no big deal." But get pecked a thousand times and you're dead. Well, we've been pecked about a dozen times in my lifetime, and dammit, it's starting to hurt a little.

We have the no smoking laws here in Ontario. Ontario is SMOKE FREE. My pet peeve. We sell cigs. in our store. Our cig sales have dropped by 70%. The Government claims that people are quiting smoking look at the statistics. I beg to differ since all my customers that used to buy cigs now go to the reserve to buy. THEY DID NOT QUIT. The government makes less revenue and the natives make a killing. Government needs to dig their heads out of the sand or out of their ASS. Sorry for the rant it is just frustrating. Angie
