Is there anyone here who is/knows/has experience with juvenile law?? There have been some MAJOR fuck ups on the part of the police dept and legal system here as far as Alex is concerned (my 15 y/o). Can you believe they came into Children's hospital and arrested him from the hospital? Well that's not exactly correct since they can't actually arrest a mino - but they came into the hospital and took Alex away in handcuffs straight from his hospital room. Any help advice or names of those how might be able to help would be appreciated. I am willing to pay for legal services obviously, I just need names I can trust. Thanks bunches.... Cat

I don't know of any attorneys in your area, however, this incident may qualify as a breech of civil liberties when removed from a facility providing needed medical care. May consider calling the ACLU? They may even provide an attorney pro-bono.

I witnessed the entire event of the night in question, they had Clark and Alex face down on the concrete driveway spread eagle. The officers approached Alex and cuffed him with hands behind his back and put him in the back of the police car. I have no idea how that can be construed as resisting arrest.... As for the uttering the terroristic threats, each time we ask, we get a different story - so I have no idea what the real charge is for that one. For those of you with kids it's a different world in schools now, all teachers and staff are "mandated reporters." If a minor utters anything that could be construed as a threat, they are required to report it to law enforcement who is required to investigate. "After school I'm gonna hunt your a%$ down and take care of business" is no longer a simple challenge to duke it out, it's now a "terrorist threat." Take it from someone who gets stuck doing all of the investigation and documentation on these things, the laws in this area are ridiculous. Everytime there is a school shooting they pass another 10 stupid laws so they can campaign under a "get tough on criminals" plank. One more aside for those of you with teen agers. Talk to them about their rights. Some people seemed angry on this thread that a 15 year old was interrogated without an attorney or a parent present. There is no legal requirement for either. The Miranda admonishment isn't even required unless he is in some sort of "formal" custody. Even if the mnor is taken to a police station, if the officer tells him, "you can leave whenever you want to"...known as a "Beheler admonishment" ....there is no requirement he be read his miranda rights. I just finished 3 years as a school resource officer....believe me when I say it's not like when we were in school in the 60's and 70's!!! Guiseppi

The very very very brief story is this: His bio father came to visit him April 13th. Alex had a characte rdie on an online game he plays , becuase the internet burped. At first he blamed me, then we got the net badk up and running. In the interim, he was cursing up a storm. His father came out of the bedroom and asked what was wrong, Alex told him to F off, then they got into an argument that led to his father pyhsically restraining him and apparently hitting him - I iessed that part; Alex walked away from his father once he broke free an wouldn't respond to him. I stepped in but attthat time Alex was upstair and I lectured him. The 2nd charge of resisting arrest is laughable...we have NO CLUE where that charge came from. Last I knew a minor couldn't be detained and questioned without a) a parent present or b) a lawyer present. So much for innocent until proven guilty. I"ll update as know more, my daughter (13) was admitted to the hospital last night as well, with everything going on she has been cutting badly and is now suicidal. Not sure where exactly I went wrong, but apparently as a mother I seem to be failing miserably OY Cat

Kids have always screwed up and always will screw up. All we can do as parents is be there to catch them. I've worked with juveniles for years, almost all of them screw up big time. The ones that pull through have the parents like you who never give up on them. You and yours are in my families prayers. Guiseppi

Cat... You have not failed with these kids. You won't fail either....ever. It's like Guiseppi says...it takes tough, caring parenting.....parents who are willing to do the work. You've already shown that you are going to do whatever it takes. Teens are going to do what they are going to do...until they get straightened out and get it right. Your kids have been good kids. They may be off track a bit right now but they will come back to what they know as right. It's such a shame.....all the bad influences that are out there making parenting so very very hard. If there were more interested parents out there, raising kids wouldn't be as difficult as it is. Ok Cat....hang in there, Sweetie....you always know where I am. Love to you all.. Jackie

Thank you everyone for your support and kind words, and I apologize for my little pity party and bad mother comment. I have no excuse, but the reason is absolute and utter emotional and physical exhaustion. As things stand, Andrea is doing well, she is smart enough to know when she needs some help and ASK for it, unlike her mother and brother hehe. Hell its call teen years, those years are hell to go through for them and us. All we can do is teach them right from wrong. What road they take we really have no control over. Beating ourself up as parents doesn't help. Just keep loveing them is all we can do. Your kids are still young enough to pick the right road, and I bet they will !
