Does anyone know anything about FMLA???

My son's employer is crazy I think. He's called in twice this year to stay home with Caleb and they gave him a point on his record both times. They said that Caleb's illness wasn't "life threatening" so he should have come to work. The kid was running 104 temp -- to me that's a reason to stay home.

I just sent a form to my neuro to fill out for him. Let them tell me that CH isn't worth staying home for and of course I need help occasionally (usually when Caleb is sick).

Is this right -- when a family member is sick?

Buddy has been there 12 years and has missed very little work (and takes all the overtime he can get), but Harrahs bought out Jack Binnion (Horseshoe) and things have really changed.

He blew up to HR yesterday, but was "visiably" upset when he got over here last night.

Anyone know where to go to check this out?

I'd quietly check with your states labor commision and labor laws regarding any type of leave. If Buddy has sick time I can't see why they would have a problem with him taking some time off. Also, document everything that is said between him and H.R., just in case this crap leads to any other actions. Odds are always in favor of the employee when it comes to issues like this.

The old story of it only takes one oh-shit to loose 20 at-a–boys.
The days of an employer looking out for the employee and caring about there wellbeing is long gone. If you have sick time you should be able to use it and not be penalized for doing so. I my self even though I work at a great place with people that understand find myself concerned over the time off I have taken even though I have not burned up all my PTO and sick time. It really sucks, like we don’t have enough stress with the pain already. I hope everything works out ok for you.

Thanks I'll start looking up labor laws in LA...

I don't know what they've done to the sick days.

One thing I'll say for Jack Binnion -- he KNEW almost all the employees and was good to them. Years ago he sent Buddy's roommate (before he got married) home to take him to ER and stay with him.  Then when a friend died he AGAIN sent Jason to drive him to Longview and stay as long as Buddy needed support.

The bad part is they've gotten rid of almost all the "older - Binnion" employees one way or another (most quit after a fashion). Buddy, right now has been there longer than any of the other employees, so he thinks they're trying to get rid of him.

They can't bitch about his work cause they have to call him out when anything goes wrong (he forgot to tell them EVERYTHING he did when setting up the computers for the slots). So I guess they're going to Mickey Mouse him to death until he quits. I told him to hang in there until they fire him and then go after them.

Thanks for the help.

Try this link--it should answer some of your questions. My sister just took a couple of weeks to help with my parents and had to have Hospice fill out some forms. Good luck. Tata

This link describes the types of reasons that leave could be granted.

Hope Caleb is OK and that everything will work out for you.

I dont know about your state, but my state is really REALLY big on employee rights, especially when it comes to family.  From what you are describing, it sounds like he was completely within his rights.

And 104 temp is quite high, isnt it?  Isn't 104 a temp that you start thinking of going to the hospital?
