Girls Can Marry at 15, Colo. Court Finds

DENVER (AP) - A 15-year-old girl can enter into a common-law marriage in Colorado, and younger girls and boys possibly can, too, a state appeals court ruled Thursday.
 
While the three-judge panel stopped short of setting a specific minimum age for such marriages, it said they could be legal for girls at 12 and boys at 14 under English common law, which Colorado recognizes.
 
The ruling overturned a lower-court judge's decision that a girl, now older than 18, was too young to marry at 15.
 
The panel said there was no clear legislative or statutory guidance on common-law marriages, and that Colorado courts have not determined an age of consent.
 
For traditional ceremonial marriage, Colorado law sets the minimum age at 18, or 16 with parental or judicial approval.
 
Colorado is one of 10 states, plus the District of Columbia, that recognize common-law marriage, which is based on English law dating back hundreds of years.
 
``It appears that Colorado has adopted the common-law age of consent for marriage as 14 for a male and 12 for a female, which existed under English common law,'' the ruling said. ``Nevertheless, we need only hold here that a 15-year-old female may enter into a valid common-law marriage.''
 
The appeal was filed by Willis Rouse, 38, who is serving time for escape and a parole violation. He argued that he and the girl began living together in April 2002 and applied for a marriage license a year later.
 
The girl had become legally independent by then, but her mother also consented to the marriage and accompanied the girl and Rouse to obtain a license, the ruling said.
 
A judge invalidated the marriage, saying anybody under age 16 needed judicial approval for either common-law or ceremonial marriage.
 
While Thursday's ruling found that the girl was old enough to marry, it did not conclude whether she and Rouse have a valid marriage. The court sent the case back to the trial judge to make that determination.

While I disagree wholeheartedly with that concept, I have a 14 and 12 year old daughter.  The thought that an 18 year old can legally go off and kill foreigners in war I find equally unsettling but he can't drink in most states.

I married my childhood sweetheart (whom I've known since we were 5) when we were 21. We'll be celebrating 24 years of wedded bliss this fall.

Personally... I think marriage should be outlawed... I thought cruel and unusual punishment was banned by the constitution anyways.

What the hell was the mom thinking?
I would like to see a pic of the mom, bet she is a crack hoer that sold the girl for drugs, I can’t think of any other reason a mom would do such a thing. I have a 16 year old daughter and there is no way I would let her get married and if she was involved with a guy over 18 he better be dam fast on his feet and stay out of my reach, or he would be one sorry SOB.

This is confusing for me.  In Pennsylvania, to be common-law, y ou have to be living with the person for 7 years!  At least, that's how I've always understood the common-law thing.  Also, I didn't realize that we were only 1 of 10 states that did this.  My best friend and I are always cracking jokes about common law marriage.  For hospital registration purposes, when you put the marital status of someone in the computer, "Common-Law Wife or Husband" is an option!  In the city, it's usually 2 people who have lived together for 7 years and didn't want to get married traditionally.  There are all kinds of laws and legal things that this changes, however!
 
So.....I guess in Colorado they don't have a 7 year requirement?  Or else a 15 year  old would have to be living with her common law husband since the age of 8.  And that can't make for any "normal" situation!

Any guy over 18 that goes out with a 16 year old is a petafile in my book, I know the older you get the less the age gap matters but crap like this is just wrong in my book.

What about an 18 or 19 year old that dates a 16 year old?  I think this happens all the time as high school seniors/college freshman do sometimes date high school sophomores...

If it where my daughter I would not want her to continue to date the guy.
That is the tough age gap to deal with and I know if it where my daughter she would not want to stop seeing someone, but my wife and I would want her to stop seeing the guy.
It would be a judgment call for sure and a tough one at that but I think most of the time when a guy gets out of high school he looses interest in the younger girls and moves on to ones there own age or older since they are out of high school.

I too am confused. For a marriage to be legal in any respect, unless I'm mistaken, it has to be consumated. If you 'consumate' the marriage, sex is involved. Common law marriage is not instantaneous, thererfore the sex happened between a 38 year old and a 15 year old before the marriage took place. Sounds like pedophilia to me!

  Glad I had a son even though I always wanted a daughter (daddy's girl), but it wasn't in the cards.
 
  I would hate to face the decision of whether or not to let my little girl date an older guy, and I am talking the 18 to 16 spread here. My son feel in love with a 15 yr. old when he was a senior in HS and 17. Her parents allowed the relationship to continue even after he went away to college hence 18 and 16.
 
  Fortunately the whole thing dried up after about 8 months of long distance love.
 
  But not to hijack the thread....yes outrageous and every bit as ridiculous as the minority of Mormons who are using religion as an excuse to get away with this kind of crap in southern Utah!

The girl is older than.  She was 14 when they started living together and 15 when he applied for a marriage license  
(at which time they were turned down).

Let me post a question.  Would you say that you're 14 year old is *mature* enough to get married or move in with their bf/gf?  Would you allow them to get married?
 
AND, it's not petafile  (I keep reading it as "pet a file"Wink, it's pedophile!
