Shit sure likes to hit the fan and make a mess DON'T IT ? Got a lady that may sue me cuz she bought two chihuahua pups and drove out of state for them and now says they are a mixed breed and I ripped her off.......huh ? The mom was never around anouther breed of male but......I don't want my name smear'd all over as a bad breeder and decieveing people. She said I did that to her.......I even had her sign a contract I am not responsible for size blah blah blah cuz of people that decide they don't like the pups look and find a reason to get there money back crap. She mentiond her vet doing DNA's on them......what good is that if none of the parents are on record anywhere and never done......cost 65 bucks each thru the club. Yipes......ok......this is my nitemare this shit happens. And Brad's new truck is stuck in low 4-wheel drive and he can't go over 30 or 40 mph......so much for askin him to cut that dam 12 foot dead tree trunk and drag it away. Look what that idea of mine caused. My mom keeps bringing up my dad bein an alkie and her goin to AAA........they been devorced for probly 15 years or so. I am a social drinker.....no problem here. I think the world is closeing in on me Pam

Hang in there Cootie. I'm sorry it seems like everything is happening at once, but that is usually how it happens.
Try not to worry about the insane sue happy bitch who bought the dogs. Some people just look for a reason to say they were ripped off, especially with animals.
And with everything else...
Try to breathe. Try to relax. Make some time for just you. Even if it is just 10-15 minutes or an hour. Make some time each day to set aside for you where you can just shake things off, try not to think about anything overwhelming, and try to relax. Don't let things get you too down. I know it is easier said than done, but I have been doing meditation lately since I have been a bit overwhelmed by taking on so many projects that I find myself a little too thinly spread these days.
You're not a bad person. Don't even THINK for one minute that everything happening is some sort of judgment or curse upon you. It's just life, and life happens.

THANK YOU Carl......I needed that !!!! I am sittin here about ready to FLIP OUT.......thanks for the support........I just don't want to bring HAVOC onto us with this dog situation. It's been a big concern cuz of what I have heard people are doing with lawsuits. And the more I sit and think about it and what the lady said via email the MADDER I get which also is not good late nite by yerself. Yeah as if I could sleep rite now ? The lady signed a contract not to come after me if she was not satisfied cuz it is impossible to predict exactly what animals will look like or size or color or shape. But I don't want the risk of a lawsuit threat or risk. Got a friend that recently got sued by anouther friend and it was a VERY sore subject for me let alone go thru sumthin similar myself. I don't know my rights.......I'd never knowingly decieve a buyer. I just don't have the confidence to fight hard enuff Pam

Try not to even think about it. If she signed a contract so she cannot sue, then let her threaten all she wants. You have the contract with her signature on it so there is nothing she can do and if she does attempt to sue, make sure you counter-sue to cover your court costs and attorny fees. Methinks the bitch will be all bark and no bite though, so don't sweat it.
And if you were downing booze, you'd just be thinking about it all over again tomorrow while feeling like shit with a hangover. And you'd get mega depressed with the more you drink, as alcohol seems to stimulate whatever mood you are in before or during drinking.
Try some warm milk instead.

I don't think you have anything to worry about. If that woman sues you with such a frivolous lawsuit, just post the lawsuit here and we will kick her ass. Your deal with her was fair and legal. Just ignore her.
Now, go tell Brad to cut that dam 12 foot dead tree trunk and drag it away. His new truck needs to be stuck in low 4-wheel drive to have the torque to yank and drag that tree trunk away. You don't want him going more than 30-40 mph anyway when he's dragging a 2000 pound 12 foot tree trunk behind the truck down the road.
When yer mom keeps bringing up yer dad bein an alkie and her goin to AAA, tell her to go to AlAnon instead.

Thanks guys......you really have helped me simmer down and think a bit more clearly and not be so MAD......I was blazein mad a bit ago and shakeing and crying...the usual panic syndrone. I did send nuther emaill to that lady tellin her I never had the female near my other males at all and they were up in a taller pen all winter anyhow off the side deck !!! I am thinkin she doesn't like how they look now for her breeding program and only used to the little short bodied stumby chihuahuas verses the bigger taco bell line with longer back and deer shape heads and can get bigger. She seen the parents so she should expect the size. So I told her what DNA testing costs per dog SUMONE has to pay and that she will have to fill out a protest form against me and pay that fee also and it is non refundable.......the testing will run close to 400 bucks and take several months. I also reminded her of my contract she signed and that I would have to have proof her pups were up to date on everything and well cared for and kept clean to take them back and not infect or infest my entire group here. I told her I would be ready to contact my lawyer when she wanted me too.......so maybe JUST MAYBE I can scare her mouth shut ??? She seen the pups and the parents and knew they were bigger style and now she is complaining about size ? Can I turn the tables on her and get her to back off do ya think and except what she bought. Course if they were MIX breeds that'd be bad but I see NO WAY that could of ever happen'd. I even have pics of the pups till they left and they looked ok. Risk of being sued and a big hassle it can get into is nothing to look forward to going thru. I am walkin on a short pier rite now Pam

Sorry to hear about the troubles Coots. I know what it is like when some days it just seems to rain shit on your life. Some days we percieve we can do nothing wright. Just gotta get past them.
The woman that boght the dog understod the deal and signed on the dotted line. As for DNA...$65 for the test??? I doubt it. A legit test is very time consuming. It sounds fishy for that price. Maybe I'm wrong but I know what is involved. More than likely her Hubby said get rid of it so she thought of an excuse to return it. If you can, financially, accept it back and find someone that wants it.
Thinge will work out Coots. They usually do.

HOWEVER, since the lady bought the dog and I'm presuming had seen both parents, she's probably sh*t out of luck. Let her have the DNA test run. If you KNOW that another male didnt' get to the female, then you don't have anything to worry about.

Now that you've told her your side of the situation, I don't think I'd have anything more to say to her, expecially via mail or e-mail. Tell her if she wants to talk, talk to your attorney. You might just accidentally say the right thing the wrong way......just like in an accident case, lawyers say don't do the talking, let them do it.
I don't think I'd worry too much if I were you. She knew what she was getting and if she just changed her mind, that's her problem.
How long have you been breeding and selling? You're good reputation speaks for itself.
I'm a worrier too, so I know how hard it is not to make up scenes in your mind, but try to let it go until there's a real problem. Right now, she's just making noise.

Well I GUESS I am joining the ranks of the sue'd.......she wanted 150 bucks sent for the one larger pup she don't want to keep and she will adopt it out and put food in her cupboards.....huh ? Nice try........LADY !! Then after a vet apt she changed her mind saying they had a wierd bark and wants the full amount and will meet me half way to get them and do it REAL soon here. I told her I thought she was up to sumthin cuz of how she kept changein her mind and would let her talk to Brad from now on ONLY. I told her "she" signed my contract and agreed to all terms.......and......if contracts ain't worth shit then who cares rite ? Oh hell I dunno......she was furious and said she was turning me into the CKC dog club but she is goin to find out she HAS to pay for the DNA's on the parents and both pups which is 65 bucks each. (I called them today) Then she said she is getting me kicked out of the club and they told her they will do that.....and she was also calling AKC club.......how bout callin AA........LADY !!!!!! Or bitch's annonomous !!? Shit if she'd been NICE to me I mite of worked with her.........this is wierd. So I sent her our phone number.......I'm not respondin anymore. She emailed me she was calling the attorney general ? The pup has the DAD'S face........no other dog here throws that short stubby black muzzle face and bug eyes.......she is just not happy with how big they got. (I warned her) and changed her mind and found sumthin else she needs the cash for I bet. So what's the process like being sued.....does anyone know ??? I have no idea what to expect other then DNA testing where ever they send me and a letter from an attorney. Is it expensive to sue sumone......or do ya find ones that take nothing but part of yer profit. Oh swell would they even want this dumb case ? I wanted 800 for both pups and gave her a deal at 625 cuz she came so far then she ended up gettin a hotel room with some other family that came with her........sheesh. I wish I was drunk Pam

jim.......my personal contract states NO GAURANTEE'S......it also says where the buyer signs that tey have read and understood the contract and that nothing else was promised to them. Basically my contract was made up based off other kennels contract samples and what I wanted to say to PROTECT MYSELF.....offers no gaurantees to them. Mainly because of this VERY thing happening. But the pup did have papers so they can go after me and do DNA stuff.....sumtimes I think selling a bit cheaper WITHOUT papers for pets only gaurantees wierdo's leave me alone too cuz the papers is a contract of sorts too sayin the dog is purebred and to my knowledge both pups are. I have never ever caught the mom in with anouther male......and the pup looks like the dad I specified also in the face and has her bigger chihuahua body. I don't lie to people and that is what turned me off about her.......she was DEAD SET I lied then said it mite of been an accident then emailed again I lied and decieved her and she was crying then again she'd settle on one pup then back at me with sueing me. I appreciate everyones responses here cuz this has REALLY rattled my cage. I was pretty despret last nite when all this came about. Can't wait for the nitemares about PAIN and being SUED tonight feature film in my head. I wonder if I will scream much.........

I showed Brad the pics of the pup in question that wierdo sent me and feel better 'in a way' that he agreed that the pups face is DEFINELTY of the dad I bred to and only that male throws it. The mom doesn't have that type chihuahua in her......but the dad is the smaller shorter snout ones which the pup looks like. He is BIG but then I have had alot of big pups out of this line and that is WHY I sell them cheaper. They look like mini teeny 8 to 10 lb german sheppards....face and all. But not the dad......him and his sister are the ONLY dogs here that have the true chihuahua face most expect. My other is a taco bell style which IS a purebred but different larger style. I even had a few that looked like mini toy boxers. Cute dogs. So why would the pup in question look like the dad if it was from a different breed. Pumping myself up for disaster Pam
Thanks again guys....................I'm still nervous about it.....who wants a pending lawsuit with everything else goin on !

You may want to try & "scare" her by telling her you are going to counter sue her cuz she is ruining your reputation as a business owner/breeder by slandering your name...Especially IF she gave your name to the kennel clubs & such..(fight fire with fire)
