Folks, it appears that since March 6th, when I requested to view my employee file after nearly 3 years of with this company, they have decided that it's time for them to "force" me to leave, or make demands that are unrealistic ( and additional ones under totally fabricated criteria) to open grounds for my termination. It's a tangled web they have woven to cover their inepness in keeping good records, denying me FMLA leave 2 years ago, doctors release forms when I was finaly allowed to return to work, ect. All I wanted was to ensure that I was not cheated out of a second week of paid vacation I have earned and should be getting this year. I had spoken with my supervisor last week about the facts and brought the documentation from my medical records to prove that I was under a doctors care, I didn't self terminate during my time off work 2 years ago when I finally got Dx correctly with this hell of CH. He said he would have an answer about my vacation no later than end of business Thursday last week. As of today I've heard nothing. My first day sick with this was March 8th, my release from doctor care came May 11th, and my first day back was June 1, 2004. Tomorrow, my supervisor and the new site supervisor (son to the president of the company no less) will be in my office site to discuss the "new" schedule changes. This is to involve working 2 to 3 nights a week untill 9 pm. Still 10 hour days. I applied with this company 3 years ago to LEAVE a second shift job. (this is debt collection, so legal hours are 8am to 9pm same as telemarketing) They know that I won't switch my shift, so when they demand it of me tomorrow, I'm certain I'll be canned. If not on the spot, then by the end of the month, because they have also demanded that I produce above and beyond realistic commission goals within 30 days or face termination, written down and forced to sign on the dotted line on the 6th of last this month as well. I need all the positive vibes I can get here folks.....my job ends, I'm done for. Financially that is. If you got some to spare....send them my way ok? Love to you all... | I've spoken with a lawyer, and he's pretty interested in the chain of events, however, WI is an "at will" employment state. It's very hard to take a case, but with the chain of events, it's not all-to-gether unrealistic. I can still be canned for no reason at all, but they would have a hard time trying to fight unemployment, which they have a long history of doing.

Pegg, take it to the employment board ! I believe in your case they will see that it is not to their advantage to fight this one. Failing that lets have the name and particulars of the company and do some clever public bashing. I have seen that tactic work before. ............here's hoping it all works out the easy way ...Tim

Contact the news with your story... One of them consumer advocate types would prolly like it... At will states are nearly impossible to fight termination, but you should still be able to collect unemployment. Dunno about WI, but most states I believe only prevent unemployment compensation when the termination is based on absences or health and safety risk to other employees (such as if you accidently stab your bastard boss with a butcher knife). If you have documentation that you correctly filed for FMLA and they denied it, report them to the Department of Labor... They'll have to prove their reason for denying it was valid. In the meantime, you prolly should start lookin' for another job... Just in case. PFDAN..................................... Drk^Angel

I don’t know anything about US labor relations but over here we have what is called an Arbitration Commission that can be used by both parties to get a ruling. Just recently I nearly went through what you are going through now, it wasn’t till I reminded them that I had taken a case against them before the commission once before and won that eventuated in me being promoted that they backed off so fast they created a vacuum.
