The problem with all this is that you have to have done something wrong in order to be indicted.
 
1.  The outing of an operative within 5 years of their last covert op is an offense - She was not a covert op in the 5 years prior to her alleged outing.  
 
2.  They will have to prove intent.  
 
When they couldn't get anything on anyone with the original authorization, they expanded the scope of the investigation to broaden the array possible offenses to indict for.  Basically, after all this time and all the money spent, they don't want to have nothing to show for it.  Someone has to hang rather than to admit they couldn't find any wrongdoing.  They're just throwing everything they have against the wall in hopes that something - anything sticks.

According to the act you mentioned (which may not be used for prosecution):  
 
(4) The term “covert agent” means—
 
    (A) a present or retired officer or employee of an intelligence agency or a present or retired member of the Armed Forces assigned to duty with an intelligence agency—
 
   (i) whose identity as such an officer, employee, or member is classified information, and
   (ii) who is serving outside the United States or has within the last five years served outside the United States; or
 
"Neither Wilson nor Plame will say whether she was stationed overseas since 1997, but Wilson responded to a reporter's question that "the CIA obviously believes there was reason to believe a crime had been committed" because it referred the case to the Justice Department."

Damage to the National Security of the United States obviously expires  exactly five years after she had been overseas (maybe one day less if there are two leap years in that period?).  Blowing her cover also blew the cover of the firm she worked for and the employees that worked for that firm, and endangered the intelligence assets overseas that she cultivated during her career, some of which may still have been providing information about nuclear proliferation in the Middle East.   So its no big deal, I guess.  Just trying to make something stick?  
 
Of course, perjury was only a crime when Clinton was in office, and he lied about sex.  Now that the issue is the compromise of intelligence assets to discredit someone who told the truth about forged documents used to drag the US into a war quagmire, its not perjury, just an attempt to 'criminalize politics.'

There are a number of other laws (including the Federal Conspiracy statutes) which are relevant:  
 
If two or more persons in any State, Territory, Possession, or District conspire to prevent, by force, intimidation, or threat, any person from accepting or holding any office, trust, or place of confidence under the United States, or from discharging any duties thereof, or to induce by like means any officer of the United States to leave the place, where his duties as an officer are required to be performed, or to injure him in his person or property on account of his lawful discharge of the duties of his office, or while engaged in the lawful discharge thereof, or to injure his property so as to molest, interrupt, hinder, or impede him in the discharge of his official duties, each of such persons shall be fined under this title or imprisoned not more than six years, or both.

The Conspiracy Statutes are quite broad, and I would bet dollars to donuts that they were violated, and that proof of intent will be served up in the next few days.

Splitting the hair fine enough was Monica's job.
Equating afternoon head against disclosing anything to do with Covert Ops (which already pretty much SUCK for the US) just plain eludes me, no matter the time frame. No idea where George himself fits in this.....probably not at all.....but god damnit, if I was him, with all this Support our War, Homeland Security, and Me......I'd be pissed as hell. Bugger party lines. This was treasonably below the belt.

Lying about trying to ruin careers of people no longer rowing with the team ain't nice. The crimes are perjury and the coverups. Focus on that.

If anyone leaked a coverts name they need to be fired. I agree with that. I also believe that if a man can not keep a commitment to his wife what makes you think he will keep his commitment to the country. That kind of thing leaves open alot of room for blackmail. As far as ruining careers politics make strange bedfellows, look at what Earl is doing to DeLay in Texas. Think Rush was doctershopping he was Grand Jury shopping. Its all political.

WASHINGTON (CNN) -- Former FBI Director Louis Freeh on Sunday accused former President Bill Clinton of ditching the investigation into the 1996 bombing of a U.S. barracks in Saudi Arabia to pursue better relations with Iran.
 
In an interview with CBS' "60 Minutes," Freeh said Clinton failed to seek Saudi cooperation with the investigation into the Khobar Towers attack, which killed 19 U.S. airmen. He said Clinton instead pressed then-Crown Prince Abdullah, now king, for a donation to his presidential library -- a charge the former president's spokesman and a former adviser told CBS was false.
 
"I was very disappointed that the political leadership in the United States would tell the families of these 19 heroes that we were going to leave no stone unturned and find the people who killed them, to give that order to the director -- because that's the order that I got -- and then do nothing to assist and facilitate that investigation, and, in fact, to undermine it," Freeh said.
 
Representatives of the former president did not return CNN calls seeking comment. But former Clinton spokesman Joe Lockhart said Freeh's accusation has been disputed by "everyone who was in those meetings."
 
"All he is trying to do is follow the right-wing playbook, which is to make up a bunch of charges about President Clinton and do it in a way that you can line your own pockets," Lockhart said.
 
Freeh is promoting a new memoir, "My FBI: Bringing Down the Mafia, Investigating Bill Clinton and Waging War on Terror." He said his Khobar Towers investigation pointed to Iran, but said the probe was derailed by Clinton's desire to improve relations with the reformist Iranian government elected in 1997.
 
He said U.S. investigators only gained access to Saudi suspects in the bombing when former President George Bush, who sent American troops to defend the kingdom in the first Persian Gulf War, asked Abdullah for his assistance.
 
Asked why he did not resign and go public earlier, he said, "I had a different response. I said, 'This is too damn important for me to stop investigating it,' and I didn't stop investigating it. I wanted for a change of administration, which happened when this President Bush was elected."
 
Clinton named Freeh, a former FBI agent and federal judge, to lead the bureau in 1993 after the fiery raid that ended the Branch Davidian standoff in Waco, Texas. But Freeh's agents ended up conducting multiple investigations of his boss during the 1990s -- including the probe of the president's sexual relationship with White House intern Monica Lewinsky, which resulted in his 1998 impeachment and eventual acquittal by the Senate.

I firmly agree that anyone actually proven to have done this needs to suffer the punishment described in the law for treason.  
 
Clinton did the sex freak thing, but that's not the worst he did (or didn't do as the case may be).  Lieing under oath, forcing others to lie under oath, coaching false statements, sending Sandy Burglar in to steal documents, giving military secrets to China, his dealings with the Saudis and the Able Danger stuff that happened on his watch not to mention refusing to take Osama Bin Laden from the Syrians on multiple occassions make him a good candidate for the stipped suit or worse.

You're right. Freeh is selling a book. I've come to the conclusion that just perhaps he doesn't care for Bill.
 
The Clinton administration produced the first huge surplusses in decades. So when Dubya took the wheel; we have almost immediately trillions in defcits that you and I will be paying thanks to the obscene tax breaks to the wealthy. In fairness, Bush did find some clever places to save a buck. He took more than a billion out of HEAP during what may perhaps be the coldest winter in years, hacked a little more out of Medicare and Medicaid--two of the most successful programs since the 1930s.  
 
In short, if it helps the middle class and below: Kill it. I've never seen such greed by people that seem to think that it's ok for the poor and especially the old, to just get along choosing amongst food, heat, or health. What is the matter with this bunch? This is not how civilized nations conduct themselves.
 
The Bush team has engaged in a tax giveaway since 9/11 that has had one underlying assumption: There will never be another rainy day. Just spend money. The Bush team's philosophy since 9/11 has been: "We're at war. Let's party."
