PITTSBURGH - A federal judge made a rare move and acquitted a man in mid-trial on a charge of illegal possession of a gun by a convicted felon.
 
Kenyatta Robinson, 25, of Pittsburgh, had been charged with as part of a U.S. Justice Department crackdown on illegal weapons. But U.S. District Judge David Cercone threw the charge out this week.
 
During Robinson's trial, federal prosecutors needed to prove that Robinson had a gun and a previous felony conviction.
 
But after prosecutors presented their case Tuesday, federal public defender Penn Hackney successfully argued that Robinson wasn't convicted of a felony because he pleaded but hadn't been sentenced.
 
Robinson pleaded guilty in 2000 to manslaughter in the 1999 shooting death of Richard Hall, 19, of Pittsburgh. But an Allegheny County judge never sentenced him for the crime. On Friday, Robinson withdrew the plea, and his case was still pending.
 
Hackney argued that the plea didn't count as a felony conviction and Cercone agreed.
 
Law prohibits the U.S. attorney's office from appealing the judge's decision to acquit after a jury has been seated. Because of double jeopardy, federal prosecutors also can't refile the charges, even if Robinson again pleads guilty to manslaughter or is convicted of a felony.
 
U.S. Attorney Mary Beth Buchanan, who thinks Cercone's decision was wrong, said her office was exploring its options.

Did ya hear about the women in Atlanta that shot her boyfriend a couple days ago.
Seems that she was upset because he was fooling around with another women.
 
It happened at a old-folks home. He was 85 and she is 78.
 
Didn't say if she was a convicted felon or not or if the gun was legal for the killing. Grin

The guy pleaded guilty to manslaughter in 2000, BUT WAS NEVER SENTENCED?
 
What the hell is going on with our justice system?
 
Smart attorney.  I say if the DA never sentenced him, the city had this coming.
