Question about selling photo rights

I recieved this email today. Quote: Dear Paul, We've found a picture of yours on Pbase.com. It's a B/W photo of thorns. We'd like to use this picture for a leaflet presenting an academic symposium on pain treatment. The print run will be 500 copies distributed in Belgium only. The size of the leaflet is 10 x 21 cm. Could you please let me know what price you'd want to get for the right to use your picture. Thans for coming back to me urgently. With best regards, |
| Has anyone here sold photo's for a run of reprints?. If so does anyone have an idea what it might be worth. The photo in questions is a scan of a 35mm shot, which was digitally modified and cropped to look like THIS. Seeing that I am not selling the rights to the original in any way I don't see how this it worth much, but having my name on the picture, even if it is in Belgium, and on a pamphlet would be cool. I think I need to get a copy of what the pamphlet is going to say first. I was also thinking that in Loo of payment to have the URL to the gallery printed under the photo. Of course if no one reading it reads English that would be worthless too. Anyway, all idea's, suggestions, comments are greatly appreciated. Opus/Paul

The price of a new car would be nice....esp for YOU. I'm no expert in this area but I do know that 'if you used sumone else's pic' and they ever found out you sold 'rights' to it you could get into a bit of a FURBALL mess. Have heard where people used pics copied off the web for personal web sites jus cuz 'they looked cool' and not thinking much about it and got into trouble. Suppose it depends on where the pic originally came from......or if you think it possible the person would find out and get ticked. I dunno.....random thoughts by a random minded person Pam

If you don't see much income coming from that photo anyway, you could just do a one-time permission to print, but GET IT IN WRITING. Make sure that it is a one-time deal only and your compensation is really up to what you want to get out of it. You still legally retain the copyright, but making a deal overseas could be pretty hard to control anyway. You could probably do a little research on licensing contracts, and do this yourself without a lawyer. Just make the terms reallly clear. And it's a really cool pic! Pat

If it's for "a leaflet presenting an academic symposium on pain treatment", I would just give them permission to use it. If the "print run will be 500 copies distributed in Belgium only", the amount they would be willing to pay you is probably insignificant. Bob

if it's being used for a pain symposium.... how 'bout invoking a 'I'll scratch your back if you scratch mine' thing? How about getting them to donate to OUCH in your name? Just a thought and definitely none of my business so I'll just be shutting up now.

Do not sell yourself short go to- www.veer.com see what other photographers are getting - around 375.00 for a high resolution photo. It might be more for a 500 run. Dan
