My life has become a sad sitcom. I mean really no one other than a writer would come up with this. Things that happened this past week would only come to writer for a sitcom. These kinds of things don’t really happen. Well you know that I moved to Utah right? Well in moving here I am staying with my grandfather and looking for a house. Somewhere between Lehi and Bountiful Utah… about a 50-60 mile area. I initially found a house to rent in Lehi, about an hour plus from my grandparents and 30 min from work. It would be about the same distance to work for me from Lehi or where I am staying with my grandparents in Fruit Heights, Utah. We looked in the Lehi area because there was a slight potential for a job for my wife there. Well I had posted before that my grandfather had a stroke. A TIA (Temporary Ischemic Attack), his third. These are minor strokes and he has almost completely recovered from this one. However he is really only able almost care for himself. The hard part for him is he takes care of his wife.. and his blood pressure skyrockets when he worries about her. She is severely disabled from a stroke several years ago. She is very demanding and often times abusive as well, but she does not know what she is doing or saying. So we need to keep his stress down. He had 4 vertebrae fused in his back recently. He is in a lot of pain and does toooo much to try to take care of her and this house. I am the only family in the state, and my wife offered to take care of them as a job rather than a stranger. So from 8-5 she will take care of them and the house, leaving them to have some private time in the evenings. So the house in Lehi was out. Jody, my wife, had already given notice to move and so she has to be out by the 31st of March. So at that point I was scrambling to find a place near my grandparents to be able to care for them and to get a place so that my family was not out on the street. Finally found the perfect house, about 3 min away... The right price, color shape, smell, community charisma etc... (my wife has been extremely particular of the houses that I have been searching for.) I set an appointment with the lady who owns it for the next day. So I show up at 11 am on sat the 12th fo March. There is another guy and his son already looking at the house... I talk to the landlord’s son who is painting the place and he thought that the other guy was me and apologized for the confusion. So I met the landlord there and gave her $300 for an initial deposit and signed rental agreement and sign a promissory note to get the rest to her when we took possession plus a full months rent. I then rent a truck and it is scheduled to get her on the 19th Fast forward to today – 3-16-05 I get a call from "Gerry" from Rent Pro who is the underwriter and does the background checks for the applications. He calls me and said I need to clarify a few things. I asked do you have questions on my bankruptcy? He said, no that was not the problem, however, I want to ask you about the eviction, and the $1400 judgment that you have against you for non payment of rent. I said woaaaaaa!.. Who was this he was talking about? He told me some name... I told him I had never heard of that woman before in my life. He was a bit rude in his reply and said "well it corresponds with your name and birth date.” He went on to ask, "Now about the assault charge that you plead guilty to." I said wait a minute... I have never been charged with assault... I have not even been in a fight since junior high. Where are you getting this from? He told me that it was my public record from the Utah courts.

And it corresponds with the other information that I have on you. He read off my name. “Kenneth P Olsen”... I said “Now wait I am not Kenneth P Olsen... I am Kenneth W Olsen.” He said well it fits with your date of birth in the court records, this is you. I said what is the date of birth? He replied Feb 8 1968. I again said NO. My birthday is June 2 1968 He then told me that is not what was on the application. I told him that I filled that application out correctly. He then said you need to prove your correct name and birth date. I said ok. How? He said fax me a drivers license and that should do it. I said how about I bring it in. So i did... I showed up and he said lets see. I will pull it up and he showed me the judgment records and pulled up the ones that had been discussed (eviction, judgments, and assault.) I again told him that it was not me and showed him my driver’s license. he was rather smug about it and said well I will show you the application.. You must have entered it wrong. He brought it up and it showed that my name was “Kenneth W. Olsen” and that I was born on June 2nd 1968! Well he said, hmmm I must have transposed the numbers. Transposed????!!!!! 6/2/68 2/8/68 ?????? He had also called Jet printing my previous employer and they did not have nice things to say about me... I have a lawsuit with them right now from discrimination and so they are not to favorable towards me. Go figure. So he had built this profile of me... Assault, evicted, judgments, bankruptcy, low credit score, relocating, and the previous employer was not positive. A real winner. So having done his job and profiled this landlord’s potential tenant, he passed this information to the landlord and said do not rent to this person base on this profile. He said that he was glad that I came in. It showed that I had initiative. He then told me that he thought that I was a nice guy. He then said.. I will tell you the formula on how and what we recommend to our clients in profile potential tenants. If there is an eviction, a charge like the assault charge. It is an automatic denial. Now with your past financial data, the bankruptcy etc, you have a lower credit score. And your potential rent is about %25 of your take home. I will suggest that because for your risk that she add an additional $600 to the base rent to cover your risk. So $1550 for a $950 house would be a fair and acceptable rent. I gasped.... He also had my income figures wrong. So I now have to have letters from all income sources to verify my income. I said that he needed to tell the owner that “He” messed up and that I really am a responsible, nice guy that gives to my community. I teach at risk kids, I am the caregiver to my grandparents. I take care of my family and I am desperately trying to get them here so we can be together again and keep them off of the street. And the does not go through you are responsible for putting my wife, my 7 year old son and 10 year old daughter on the street with no where to stay. He said that he would tell her "That I disputed the allegations, and that they were corrected." That a little sanitary and does not own up to the fact that he made a mistake. He told me that “yes” he made a mistake and that I should understand. He continued to say that since I work with computers that could happen and it is not a big deal. He did call her and told her that the information that he gave to her had a mistake in it. Now that was big of him. I tried to call her and there was no answer. So I went to her house. Outside there was a guy already there waiting to see the landlord. This was the same one that had been looking at the house on that Sat. Evidently she had already called him to come and apply based on the recommendation of Gerry. She showed up within few min and I went in. I told her that I needed to try to explain what had happened. She said that he told here that there was a mistake. The landlord assumed that her data entry gal had entered the info in the computer incorrectly and did not question him further. He did not take responsibility for the mistake and brushed it over like it was no big deal. I told her everything and that my wife was in limbo and I don’t know what is going to happen next. I now have to verify my income from all the sources, and fax it all to him tomorrow and he needs to verify and give her a recommendation based on that. What do I have in my favor here? $300 and a signed rental agreement? I signed it, she may have signed it later but not when I did. Do I have any recourse? I am ready to have a conniption fit……. My head is splitting down the center and green lights ooze are seeping from my skull.

No good deed goes unpunished, eh? Try to do the right thing and get waylayed coming and going. What a piece of shit this guy is. You prove you are not this other person and they still treat you like a criminal. I don't know what recourse if any you have, but I am sorry you are going through such a rough time. I sincerely hope things get better for you and your family very soon.

I am so sorry... Some people just want to ruin things for everybody... I must say that I think it's so wonderful how you can your wife want to take good care of your grandparents. Not everybody would do that. I pray that things will turn out the best. That there'll be a silverlining to that dark cloud somewhere. I don't know if you believe in affirmations, but if you do, check out Joseph Murphy's book "Power of your subconcious mind". I'd send suitable affirmation for you, but unfourtainly I don't have my copy of the book here in Jyväskylä where I live now... it's back at my mum's place in Helsinki. When I want smile instantly, I come here or go to www.garfield.com. Those cartoons make me feel better no matter what's going on in my life. Garfield made me smile even when I was depressed a year ago (check out wake up call: take this seriously). I wish you the best. Your family are in my prayers. Sandie

I'm sorry Athos, this all sucks. Is this guy the owner of the rental agency or just an employee? If so I'd demand to see the boss and demand a full written apology and preferential service now or failing that go elsewhere. THEY need you not vice versa. THEY are getting paid to find YOU a home. Plenty of other agencies. I know time is against you and I realise how stressful that is too though. Let us know how you get on Helen

Man! They say Kafka had cluster headaches, and your life has definitely turned Kafkesque. In my (non-lawyer) opinion, you have incurred damages due to the negligence of others, and are entitled to a correction of the situation and maybe restitution. Whether or not the state or federal legislature has shielded the credit companies or the other bums from liability, I don't know. Hang in there, this is like a thunderstorm. There is lots of noise and your adrenaline is pumping, but it will blow over, and once you clean up the branches in the yard, life will go on as usual. PS: been meaning to order a shirt from you, just went to the xdup.com website, will have to straighten out my paypal account - my card on file with them expired, they wont let me edit the existing one, cant delete and then add it either.

Please contact an attorney in your area and speak with one that will give you a free consultation. At least then you will know if you need to hold this stress or move on to the next one. Sometimes there are "if" clauses on agreement contracts or "good faith" contracts that allow one or the other signers to back out depending on extenuating circumstances. At a minimum you should get your $ back. Sounds like the investigator may be injurious to you through slander, so check it out. Hope your outcome is in your favor as it should be. Ken........ ...you know, you have to make it.......this is simply wrong, and I would LOVE to see a local TV journalist run with this story. I dont think I ever got exactly how they got the misinformation...some of that stuff is not included on a FICO score.......you've heard me say it before DOCUMENT!!!!! Get it down on paper, write names and times. lay it all out.then call your local newstation...as well as notifying your rental company of such. See what THEY want to do about rectifying before the ombudsman gets into their office.

It's pretty obvious that guy jus plain DON'T CARE......kinda like them lawyers that will take any case.......cold hearted person for a cold hearted job. Too many people to take your place......too fast. I believe sum do frown on anyone with a lawsuit goin on......figurein them for bein suit happy and 'they could be next' theory.
