Asking for some real help.
« on: Jan 17th, 2005, 10:24pm »

I have been around more clusterheads than any non-cluster having, non-cluster-true-supporting-person that I know.  I have read enough on this board to know what kinds of crisis happen, when people have had enough, and when to say fuck it I need to say something and I don't give a shit who likes it.

This is one of those times.  I'm sorry if you don't like it but its not about me.

A fellow clusterhead of yours is in and has been in  a real crisis for some time now.  This probably applies to more than one person reading this, but this is about specifically one person.

If you are in Texas and want to help one of your sisters that is on the brink of a deep breakdown, vibes are not needed.  Don't send flowers.

In the Dallas area, if you know of a women's service or know of someone that can help single woman in money and health crisis, a pantry that will put food on the table for her and her children, a counselor that will help to walk this person out of the depths of despair, please send me a pm.

She has tried family to no avail, and she is at the point where she honestly feels she cannot help herself, and that there is nowhere to turn.  I cannot go there right now, I wish I could.  But I will do the best I can by asking you all as fellow clusterheads of hers and women that may have been down the same road, for resources to access at this time.  Anything that will help temporarily for relief until there is a plan of action, will help.

I'm looking for stuff online but if you know of anything, please, please either email or IM me as soon as you can.  I am really worried here, and NO we're not related and I'm not making this shit up for attention.

Any info you can send this way is truly truly appreciated.

Barb, that would be the quickest way to help with the situation at least temporarily, for sure.  If people can do that, by all means.

If it comes to people wanting to do that, I can get her address, (I didn't realize i left her name off before, but you know Its Donna D. ) to organize that.

I asked for resources because Idon't know what people can do out there.  Donna is getting hit pretty bad and has nothing to help her, she's out of medical insurance and her boss is shafting her again with bad checks.  Talk about taking advantage of someone.   Angry

When I first decided to leave my first husband, they had me go into an emergency shelter for mine and the kids safety.  I elected to not go into the live in shelter, but they helped me get subsidized housing, food and clothing for the kids.  They made sure I had all the right things in place to ensure the safest and best outcome for myself and my kids.

This was done in Canada and I know the US is different, but they are very good resources that can help.

COS (Catholic Outreach Services) serves the needy of San Angelo...

Sponsored by the five Catholic parishes in San Angelo & working in concert with local churches of various denominations and city social service agencies. COS offers a place where needy citizens can get food, clothing and assistance with such things as rent & utility or medical bills. Food, clothing and funding comes almost exclusively from parish support and private donations. With the exception of a paid director, the store at 102 North Chadbourne depends entirely on dedicated volunteers to keep its doors open

ok i'm at work so i am going to do this quick - if I don't respond right away its because i can't.

thanks for all the pm's .
if you want to send her paypal for those who are asking where to send some cash, she has a card where she can access her paypal fund right away.
the NEW paypal address is :

smileyone1968@yahoo.com

For western union I wouldn't post her address but if you want her address specifically to send anything at all, I can email you, please email me directly at

peppermint2867@yahoo.com,
its not wise for me to spend a lot of time on here while I'm at work, however I am allowed to go to the yahoo site.   Roll Eyes stupid rules.

I think any type of care package you want to send is welcome, Donna was really distraught, and those who jumped at this last night, I just want to tell you she went right out to get groceries.  not having a sitter is tough.

I fielded a lot of folks messages last night so thank you ladies who came up with the links and info for her - she has a job but her paychecks are bogus so I say its time to move on, this has become mUCH bigger than her problems with her EX if you can fathom that.  He's the least of her worries now.

Gotta jump boss is getting back, send email.

It's also possible to send money via Western Union. Although there is a charge for it. PayPal may be cheaper. If you want to Western Union PM me for her full name.

Regarding the bad pay/compensation checks your employer wrote, Donna:

SPECIAL KINDS OF CHECKS
Payroll Checks

You may present a bounced payroll check for prosecution of issuance of a bad check. A payroll check is not prosecutable as theft by check. You can also contact that Texas Workforce Commission at 1-800-832-0243 to determine what recourse is available to you through that agency.

http://www.co.lubbock.tx.us/CDA/hot_checks.htm

Texas has, since its inception as a nation in 1836 and its later incorporation into the United States, been a jurisdiction that is kind to debtors. This is in contrast to the practices of other states that are much more pro-creditor.

Many of the Americans who came to Texas during the initial Anglo settlement of the area came to start a new life and left behind their old life, including their debts. The letters "GTT" left scrawled on one's door in Kentucky amounted to a form of de facto bankruptcy making it clear to any creditors left behind that their extension of credit was an unwise one.

The nature of the founders of Texas has much to do with its liberal laws in favor of debtors. Considerable protection for debtors is contained in the Texas Constitution. Considerable property is exempt from seizure to pay judgments, for example. The majority of people in Texas are, in fact, judgment proof, meaning that all of the property they own is exempt from seizure to pay debts nor can wages be garnished form payment of most debts.

Our criminal laws are drafted in a way that acknowledges and expands the pro-debtor bias of the constitution. For example, the definitions regarding theft explicitly state that deception for purposes of the theft statute does not include mere failure to perform on one's contracts. Another example is a provision in the probation laws of this state (now called community supervision) which prohibit a judge from revoking probation of a defendant (and imprisoning him) if he/she fails to pay restitution if that defendant can show that he/she is unable to pay restitution.

The law of Issuance of a Bad Check makes it a crime to write a bad check, even if the check is for payment of a pre-exiting debt, but (with the narrow exception of checks written for child support) it carries no imprisonment as punishment. The maximum punishment, in fact, is a fine of $500.00.

With the foregoing historical background, it is easy to understand that Texas does not criminalize the owing of a debt. If a bad check is given to pay a debt, the issuance of that check, while it may be a criminal offense, is not a theft. Instead, it is the non-imprisonment offense of Issuance of a Bad Check.

Phrased another way, a bad check is a lie. If the person who wrote the check led you to believe it was a good check, yet knew it was not good, he or she lied to you. The lie is punished as Issuance of a Bad Check. On the other hand, if a person lies to you in order to get you to give them property or services and you give them the property or services because you believed the lie, the person committed a theft.

Lying with checks and stealing with checks are two separate offenses. Lying about whether a check is good (and introducing it into commerce) is Issuance of a Bad Check . Using a bad check to deceive another out of his/her property is theft. The other check offense involves signing another person's name on a check. That crime is Forgery if done with intent to defraud.

Although in most cases a check given for a pre-existing debt does not meet the requirements for a theft charge, a very narrow exception exists. IF the check writer obtained possession of additional merchandise or secured the performance of further service because he/she paid a pre-existing debt, then the check writer may have stolen the additional merchandise or the further service if he/she would not have been able to obtain the merchandise or service without paying the existing debt. If you think your check may qualify as a theft even though its purpose was for payment of a pre-existing debt because the check writer secured further merchandise or services by writing the check, you may contact us

Um, not sure what you mean.   Huh

On behalf of Donna, thanks to all of you for the way you have been so supportive, and for being generous with your pockets as well.  I will let her thank you in depth on her own, she just asked me to mention how overwhelmed and grateful she was.

I'm really struck by the responses personally....

I think its really important that the information here is put to good use.  I am just getting home to look here, and all those women's services posted by you Kimh and Catlind.... those things are PRICELESS.  You know it and I know it.   Anyone else that can post short term resources leading to long term solutions, that is invaluable, please do.
