Am I a Terrorist?

Last year, I really wanted to attend the convention in NY but due to financial problems and an upcoming bankruptcy, it was out of the question.
 
In the past year, I have got the bankruptcy taken care of, and while I'm still having financial problems, they are mainly due to the fact that I am taking a number of classes right now and not working.  However, there does seem to be light at the end of the tunnel --- I only hope it isn't a train. Wink
 
Last year, I knew there *might* be a problem with me crossing the border due to some old criminal charges, but never pursued the matter further because of the financial problems.
 
Recently while looking into the possible legal problems I might encounter at the border, I found out some very interesting information.  Because of a recent international agreement, the US law-enforcement agencies are able to access RCMP files to determine if someone attempting to enter the US is "undesirable".   (OK -- NO smart-ass remarks!!!   Grin)
 
I was originally told to apply for a pardon and have my record sealed.  Apparently, this does almost nothing when it comes to entering the US since they won't recognize a Canadian pardon.  BTW - there are very few other countries ANYWHERE that would refuse me entry because of a couple of assault charges relating to a couple drunken fights more than 10 years ago.
 
While there is still a chance, it doesn't look good.  It seems the best option I have is to apply for a waiver upon entry.  This could be a problem as I would hate to buy a plane ticket, only to find out that when I got to Nashville I would immediately be put on a plane home.  (I could drive the 200+ miles to the border and try this approach ahead of time.)
 
On the bright side, if the charges in my past were drug- or weapon-related, I would NEVER be allowed entry into the US.
 
While I'm aware that the millions of illegals you have there did not legally entry the country (hence the term) and the hundreds of terrorists that are present at any given time probably entered using false ID, I am insulted that I am being refused entry to a country that is home for a number of relatives and my friends here on the message-board as well.
 
What pisses me off more is that while these charges are dated and alcohol-related, I haven't had ANY legal problems in over 10 years and haven't had a drink in 8 months (it will almost be a year by the time the convention begins.)
 
Also, this will severely limit my employment options.

EDITED: I wish that I hadn't left the board between cycles prior to 18 months ago.  I would have known about the Vancouver convention.  Its only an 18 hour drive from here with NO borders to cross.

I was charged with attempted murder in the early 80's, I was able to plea bargin down to assualt and battery with a deadly weapon....still, a felony that I was convicted of.
 
I got through customs without even a passport to attend the Vancouver convention....Getting back into the states was a different story....Even though I was a citizen they tore my luggage up looking for shit (Something they didnt do while entering Canada)
 
Grant, I'll steal a pipercub and fly under radar to get ya......Convention or bust!!!! (and I mean "Bust"Wink....LOL Grin

Our paranoia here is rampant and hits all the wrong people. The mad bombers and terrorists aren't going to look for a nice customs station.  Idiocy at its extreme.  
 
Not sure what we can do. A further example is a businessman who was born in Canada but has lived here all his life near me. He went home  to his family with tons of special paperwork just in case something like this might happen. It took him several months to get back home because of some moronic bullshit that a twit on the Buffalo side of the river decided to pursue. Never have I seen something so stupid and just plain nasty.  It's a sad state of affairs.
 
This is the kind of thing that should have had special attention...even from Washington. Reagan would have loved this.  Not today though.  Really pisses me off. The guy with the ammonia nitrates doesn't have this kind of worry    Angry

It seems that only the mexicans can get into this country with no problem.....then they can put their kids in school and the school is not allowed to ask them if they are citizens.....Man, Dont get me started....LOL

Jonny, almost 400 Mexicans die every year crossing the border.  Another 2,000,000 get arrested and sent back.

Well, someone should tell them to get in line or stay home.
 
Did you know that they can walk into a hospital (Not even speaking english) and the hospital staff are not allowed to ask them if they are citizens?

foreigners may be denied entry if they have been  
 
convicted of a criminal act in Canada or abroad. An offense is considered criminal if it is defined int he  
Criminal Code of Canada or other acts of Parliament, regardless of whether the offense is considered criminal in the country where it was committed.
 
Important note: impaired driving is considered a criminal offense, a fact that can take visitors by surprise at the border.
However,
 
Deemed Rehabilitation:
a foreign national who has committed one single criminal offense outside Canada may be deemed rehabilitated if 10 years have passed since the completion of the sentence imposed and if the person has not committed any further criminal acts.
 
this applies to offenses that, in Canada would draw a maximum sentence fo less than 10 years.
 
there will be no administrative fee, but authority to allow an individual to enter Canada will be based on an assessment of risk and other factors at the border examination.
 
deemed rehabilitated, is not automatically entered into government databases, therefore visitors should not expect to be automatically allowed to enter, though entrance was granted on previous visits.  Only frequent visitors are entered in the database.
 
 
I live in Detroit, this stuff is kept handy.

Our government has spent many millions here to keep things tight with so much traffic going through the tunnel to Windsor or crossing our Ambassador Bridge and Blue Water Bridge up the road between the countries.  Things are going better, but the Canadian government does not care if the trucking lines carrying goods to or from are backed up two miles.  No chances are taken.  So much commercial traffic travels to and fro, most from the big auto companies, things are serious here.  Even General Motors has invested millions too to improve inspections with technology when shipments were delayed days while they depended upon on time delivery for "just in time" inventory.  They bit the bullet and thought it in their best interest to help by funding for the implementation of new technology.  
  We ain't no easy way in anymore.  State of the art.

I know that records can be expunged.  Ex inmates here,  can file a document with the court and under court order, those records are expunged.  Once expunged, they cannot be reported to another agency.
 
Wish I knew more about Canadian Law.   However, it should be available via the internet.  Just not sure if any revisions are updated.  Certainly alot has changed since 9-11.
 
I have some contacts....gonna see what I can find out.

That was enacted June 28, 2002.
 
Revisions?  That was from their site 6 months ago.
 
Canada may have their own rules about what is considered rehabilitated.  You are right, they go by Canadian code, regardless of criminality in country committed.  They state 10 years without another criminal act, that may be their definition they go by.  I know expunging takes time (5yrs?)  
  These are most useful general terms put out by the Canadian Tourism Commission.  The depth of expunging by another country is not clear, but certain privacies were put on the back burner in favor of better security.  The exchange of info is thorough now, however, Canada is our friendliest neighbor and perhaps may comply with U. S. codes where it sees fit for their own security.  
   
Detroit has the largest Arab community in the U.S. and after 9-11 much came under scrutiny.  For the most part it is a U. S friendly community of Arabs here in Detroit, but the F.B.I. came down hard here.  Certain "things" were discovered.  Canadain and U. S. customs keep a tight lock on nothing coming through, to or from.  
  Your point may be correct, but if interested, it would take looking into.  I would not take anything for granted.
