CH Suffers Who Use O2 & Smoke:

-- Got Any Landlord Legal Issues / Concerns-Fears?!!?

Are there any CH suffers who smoke that've had "legal issues" with their "landlords"... about smoking near O2 tanks, (No less than 10-20 feet away from O2 storage unit(s)??  Anyone who's had to "defend themselves" against a landlord who feels your smoking+O2 tanks could "blow up the apartment" building?  If so, I would really welcome a lead on how to "legally protect myself" ... should the landlord have "eviction plans"!!!

The repairman after painting yesterday "expressed concern" about my smoking while in the same room as my O2 tanks, (I rent a Bachelor apt).  My building manager calls tonight and says that "the landlord has a real problem with you smoking and having O2 tanks... we need to talk ASAP!!??!!

With our disease; I being a smoker truly understand safety concerns about O2 use and smoking in proximity to O2 tanks.  I'd of course never ever smoke while I was doing O2 therapy, that's neglegent and just asking for "fire safety hazzards".  I always make sure that the regulater valves "are turned tightly in the off position; and that I'm at least "10 - 20 feet on the other side of the apartment.  Else, tanks are stored in enclosed in  my long closet.

Please advise, as those of us who smoke are way too sick to deal with something like this.... needless to say; the Manager's call "induced shadows" or, a "mild CH"... I'm not the first to go through this sort of thing; just the latest one.  All advice is truly appreciated!!!

Thank you,

These supposed dangers of oxygen are usually greatly exagerated, as a simple calculation shows.

As an example, my computer room has a size of 4.7 x 3.4 x 2.5 meters, giving a volume of 40 m3, equivalent to 40'000 liters. Oxygen makes up ~21% of natural air, so this room contains all the time 8400 liters of O2. If I breathe 10 liters/minute for 10 minutes 100 liters of oxygen will be added to the 8400 already present, e.g. the O2 concentration will raise from 20.947% to an appaling high value of 21.196%.

Even if I emptied the whole tank (4000 liters) at once the oxygen content of the room would increase by less than 50%.

What happens if the tank explodes? If you heat up the tank to 320°C (620°F) the pressure inside will double, and if it was full you'd reach about the test pressure. But if you reach this temperature in your flat the only thing worthwhile to salvage would be the gold from the teeth.....

The landlord should be much more concerned if you have a box of matches or a cigarette lighter in your flat, and a camping cooker would be like a nuclear bomb compared to the oxygen tank.

I have to agree with Ueli on this.

And, I think your landlord is

1. being overly cautious.

2. lacking intelligence about oxygen use.

3. a complete fool.

4. all of the above.

I see people dragging an oxygen bottles, canules up their nose and smoking at the same time.

Fire/Rescue teams take oxygen bottles to fire scenes and use it on victims while the building is burning near by.

Welding shops can have many bottles of oxygen on hand at any given time and what are they doing with it? Making fire!

If you have a legal prescription for oxygen and have received it from a legal source I can’t see where there would be any grounds for a landlord to cause you any trouble.

But I’m not a lawyer.

My wife was overly paranoid about me smoking around the O2 tanks so I performed a little experiment...
I disconnected the tube from the O2 regulator and turned it on at 8 litres per minute. Then I put my lighter up real close. Guess what? The flame is a little brighter. (Big deal). To listen to her ranting while I was doing this... you'd think I was going to blow up the house.

The problem starts when the valve has a leak over a period of time in a room with little or no air circulation, like a bedroom. The O2 will slowly saturate the furniture, carpet, clothes, etc.
Then when a match is lit the fun starts.

But only if the match actually touches the furniture, carpet, clothes, etc. Simply lighting a match or smoking in an O2 filled room won't do anything.

Working on the housing industry I have to say your landlords concerns are valid.

He is responsible for the health and safety of his other tenants and if there is any question of an explosion or fire hazard he is responsible for checking it out. He would be an irreponsible landlord if he didn't address a concern such as the one that he has. The concern may very well be groundless but he doesn't know that until he speaks with his tenant and gathers the appropriate information.

Do you have a lease? Are you a tenant at will?

Sit down with him and address his concerns.

Ive mention'd this b-4....so sorry for the repeat....but my mom got severely burnt dureing a simple operation when they had an oxygen tube taped to her chin and were catarizeing small spots on her face. (she has melenoma).....the spark from the caterizer ignited the oxygen and the fire was so 'light' in color the docs were frantically trying to put out her gown not realizeing at first her face was burning....some fire flashed down into the tube sumhow and so that caused a blaze to shoot out and burn her nose badLY they were also working to reconstruct slowly from the melenoma area they had to remove. She tried to sue the hospital but to no avail and a long drawn out process of many years. So it jus goes ta show ya....shit happens or can happen. Even if rare.  Pam that's seen alot of shit

Maybe not legally but if your a "tenant at will" he has a million ways to fuck with you. He only needs one though and thats called  "a 30 day notice to quit"
